MARANA ORDINANCE NO. 96.24
AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF MARANA, ARIZONA,
AMENDING CERTAIN SECTIONS OF THE MARANA SPA AND POOL CODE, 1995
EDmONBY INCREASING THE ENCLOSURE AND BARRIER HEIGHT REQUIREMENTS
OF POOLS AND SPAS, AND REPEALING AIL RESOLUTIONS, ORDINANCES, AND RULES
OF THE TOWN OF MARANA IN CONFLICT THEREWITH.
WHEREAS, the Town of Maran a did adopt the Marana Spa and Pool Code by reference in
Chapter 7 of the Marana Town Code on December 19, 1995 which outlined regulations for the
construction of pools and spas within the Marana town limits; and
WHEREAS, the Mayor and Council desire to amend the Marana Spa and Pool Code to
increase the enclosure and barrier height requirement to five feet and believe that the amendment
is in the best interests of the town and its citizens.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council as follows:
Section 1. The Marana Pool Code is hereby amended, with additions shown by underline and
deletions shown by strikeout as follows:

Sec. 317.(a) Outdoor residential swimming pools shall be provided with an enclosure and
barrier meeting the following requirements:
1. Barriers and enclosures shall be a minimum of 4-~feet in height above finished grade or
other walking surface, measured on the side opposite the swimming pool.
See. 417.(a) Outdoor residential spas shall be provided with an enclosure and barrier meeting
the following requirements:

Sec. 510.(a) Residential portable spas shall be provided with an enclosure and barrier
meeting the following requirements:

See. 618.(a) Outdoor aboveground swimming pools shall be provided with an enclosure and
barrier meeting the following requirements:
1. Barriers and enclosures shall be a minimum of 4-i.feet in height above finished grade or
other walking surface, measured on the side opposite the swimming pool.
Section 2. The various town officers and employees are authorized and directed to perform all acts
necessary or desirable to give effect to this ordinance.
Section 3. All Marana ordinances, resolutions, or motions and parts of ordinances, resolutions, or
motions of the council in conflict with the provisions of this ordinance are hereby repealed, effective
as of the effective date of this ordinance.
Section 4. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any
reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,
such decision shall not affect the validity of the remaining portions thereof
