HomeMy WebLinkAboutOrdinance 96.25 Amending section 02 of the personnel policies -- MARANA ORDINANCE NO. 96.25 AN ORDINANCE OF THE TOWN OF MARANA, ARIZONA, AMENDING SECTION 02 OF THE MARANA PERSONNEL POLICIES BY ADOPTING SECTION 02.13. FINGERPRINTING REQUIREMENTS FOR TOWN EMPLOYEES WHO WORK WITH CIDLDREN, AND REPEALING ALL RESOLUTIONS, ORDINANCES, AND RULES OF THE TOWN OF MARANA IN CONFLICT THEREWITH. WHEREAS, the Town Council did, on the 19th day of December, 1989, adopt Marana Town Ordinance No. 89.32 revising the Marana Personnel Policies, and has amended the policies from time to time; and WHEREAS, it has been determined that the adoption of Section 02.13. Fingerprinting Requirements is in the best interests of the employees and citizens of the Town of Mar ana. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Town of Marana Arizona as follows: Section 1. The Marana Personnel Policies are hereby amended by adding section 02.13. Fingerprinting Requirements as hereinafter set forth; 02.13. Fingerprinting Requirements. 02.13.01. Purpose: It is the policy of the Town of Maran a that all children engaged in Town activities supervised by Town employees shall be safe from abuse. Consequently, all potential employees and current employees whose job duties include unsupervised contact with minor children shall agree to be fingerprinted so that a criminal background check can be completed. It is the goal of this policy to provide a safe and healthy environment for children. 02.13.02. Fingerprinting Requirements: All potential employees and current employees whose job duties include unsupervised contact with minor children must submit a full set of fingerprints for the purpose of obtaining a state and federal criminal records checks. (A) The full set of fingerprints shall be submitted to the Arizona Department of Public Safety who will run a criminal background check. (B) Arizona Department of Public Safety is authorized to exchange this fingerprint data with the Federal Bureau of Investigation pursuant to A.R.S. ~ 41- 1750 and public law 92-544. 02.13.03. Confidentiality Requirements: The results of the criminal background checks run on the fingerprints shall be provided to the Human Resources Director Marnna, Arizona Ordinance 96.25 Page 1 of2 for the Town of Maran a and the Human Resources Director shall keep such results confidential. 02.13.04. Consequences of Refusal to Submit to Fingerprinting: Any potential employee who is subject to the requirements of this policy and who fails to agree to be fingerprinted shall not be offered employment with the Town. Any current employee who fails to agree to be fingerprinted shall be subject to immediate termination. (A) Termination of an employee under this section shall be subject to the notice provisions of Section 02.10.05 and appeal provisions as set forth in Article 5. (B) Termination of an employee under this section shall supersede the progressive discipline policies as set forth in Section 02.10.09. Section 2. The various town officers and employees are authorized and directed to perform all acts necessary or desirable to give effect to this ordinance. Section 3. All Marana ordinances, resolutions, or motions and parts of ordinances, resolutions, or motions of the council in conflict with the provisions of this ordinance are hereby repealed, effective as of the effective date of this ordinance. Section 4. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof.
