HomeMy WebLinkAboutOrdinance 96.27 Changing the zoning near Silverbell Road and Linda Vista Boulevard -- MARANA ORDINANCE NO. 96.27 AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA, CHANGING THE ZONING OF CERTAIN PROPERTY LOCATED AT THE SOUTHWEST CORNER OF SIL VERBELL ROAD AND LINDA VISTA BOULEVARD FROM "ZONER-I44" (SINGLE FAMILY RESIDENTIAL, MINlMUMLOT SIZE 144,000 SQ. FT.) TO "ZONE R-36" (SINGLE FAMILY RESIDENTIAL, MINIMUM LOT SIZE 36,000 SQ. FT.). WHEREAS, Casa Royale Builders, Inc. is the owner of a parcel of land located at the southwest corner of Silverbell Road and Linda Vista Boulevard, NE 1/4 of the NW 1/4 of Section 20, TI2S, RI2E, Assessor's Parcel Number: 221-02-002, approximately 37.3 square acres in size, and more particularly described in Exhibit A, attached hereto, which is currently zoned "Zone R- 144" (Single Family Residential, minimum lot size 144,000 sq. ft.); and WHEREAS, the owner Casa Royale Builders, Inc., has applied to the Town of Marana to change the zoning of this property from "Zone R-144" (Single Family Residential, minimum lot size 144,000 sq. ft.) to "Zone R-36" (Single Family Residential, minimum lot size 36,000 sq. ft.); and -. WHEREAS, the Marana Planning Commission held a public hearing on the rezoning request on March 27, 1996 and following this public hearing recommended that the Town Council approve, with conditions, the request for rezoning the property located at the southwest corner of Silverbell Road and Linda Vista Boulevard to "Zone R-36" (Single Family Residential, minimum lot size 36,000 sq. ft.); and WHEREAS, the Town Council of the Town ofMarana held a public hearing on the rezoning request on June 18, 1996 to obtain public input on the request for a change of zoning, and heard from staff and the owner, and has determined that the rezoning request should be approved, with conditions. NOW, THEREFORE, BE IT ORDAINED that the Mayor and Council of the Town of Marana, Arizona as follows: Section 1. The zoning of that certain property located at the southwest corner of Silverbell Road and Linda Vista Boulevard, approximately 37.3 acres in size and more particularly described in Exhibit A attached hereto, is hereby changed from "Zone R-144" (Single Family Residential, minimum lot size 144,000 sq. ft.) to "Zone R-36" (Single Family Residential, minimum lot size 36,000 sq. ft.) subject to the following conditions: 1. The developer shall submit a revised site analysis to town staff prior to the preliminary plat process. 2. The developer shall submit a plan of compliance with the Marana Native Plant Ordinance prior to the issuance of any grading permits for the property. ~ Marana, Arizona Ordinance 96.27 Page 1 of2 ,-- Section 2. All Marana ordinances, resolutions, or motions and parts of ordinances, resolutions, or motions of the council in conflict with the provisions of this ordinance are hereby repealed, effective as of the effective date of this ordinance. Section 3. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof PASSED AND ADOPTED by the Mayor and Council of the Town of Maran a, Arizona this 18th day of June, 1996.
