HomeMy WebLinkAboutOrdinance 96.30 Amending certain sections of the uniform building code 1994 edition MARANA ORDINANCE NO. 96.30 AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF MARANA, ARIZONA, AMENDING CERTAIN SECTIONS OF THE UNIFORM BUILDING CODE, 1994 EDITION BY ADDING A FOOTNOTE TO TABLE 16-0 ALLOWING EXISTING POOL WALLS TO BE INCREASED WI1HOUT A HORIZONTAL FACTOR, AND REPEALING ALL RESOLUTIONS, ORDINANCES, AND RULES OF THE TOWN OF MARANA IN CONFLICT THEREWITH. WHEREAS, the Town of Marana did adopt the Uniform Building Code by reference in Chapter 7 of the Marana Town Code on December 19, 1995 which outlined regulations for the construction of structures within the Marana town limits; and WHEREAS, the Mayor and Council desire to amend the Uniform Building Code to allow existing pool and spa walls to be increased without a horizontal force factor and believe that the amendment is in the best interests of the town and its citizens. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council as follows: Section 1. The Uniform Building Code is hereby amended by adding the following footnote to Table 16-0, with additions shown by underline and deletions shown by strikeout, as follows: -- EWith the approval of the Town Building Official. existing barriers built to comply with the pool enclosure safety requirements may be increased without modifying the horizontal force factor. Section 2. The various town officers and employees are authorized and directed to perform all acts necessary or desirable to give effect to this ordinance. Section 3. All Marana ordinances, resolutions, or motions and parts of ordinances, resolutions, or motions of the council in conflict with the provisions of this ordinance are hereby repealed, effective as of the effective date of this ordinance. Section 4. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof ,- Marana, Arizona Ordinance 96.30 Page 1 of2 PASSED AND ADOPTED by the Mayor and Council of the Town of Maran a, Arizona this 18th day of June, 1996.
