AN ORDINANCE EXTENDING AND INCREASING THE CORPORATE LIlVIITS OF THE
TOWN OF MARANA, ARIZONA, PURSUANT TO THE PROVISIONS OF TITLE 9, CHAPTER
4, ARIZONA REVISED STATUTES, AND AMENDMENTS THERETO, BY ANNEXING
THERETO THAT TERRITORY KNOWN AS TEP/I-10 ANNEXATION, WHICH IS
CONTIGUOUS TO TI~ EXISTING TOWN LIlVIITS OF THE TOWN OF MARANA, ARIZONA,
AND CHANGING THE ZONING FROM "ZONE CB-2" TO "ZONE VC", "ZONE SH" TO
"ZONE R-36", "ZONE CI-2" TO "ZONE HI", AND "ZONE R-1" TO "ZONE R-36".
WHEREAS, a petition in writing, accompanied by a map or plot of said real property, having
been filed and presented to the Mayor and Council of the Town of Marana, Arizona signed by the
owners of more than one-half in value of the real and personal property and more than one-half of
the persons owning real and personal property that wotild be subject to taxation by the Town of
Marana as shown by the last assessment of said property, which said property is contiguous to the
Town ofMarana, and not now embraced within its limits, asking that the property more particularly
hereinai~er described be annexed to the Town of Marana, and to extend and increase the corporate
limits of the Town of Marana so as to embrace same; and
~~HER~AS, the ~~Iayor an~ C~t~ncil ~f the T~~un of Marana, Arizona are desir.ous of
complying with said petition and extending and increasing the corporate limits of the Town of
Marana to include said territory; and
WHEREAS, the petition sets forth a true and correct description of all the exterior
boundaries of the entire area proposed to be annexed to the Town of Marana and had attached
thereto at all times an accurate map of the territory desired to be annexed; and
WHEREAS, no alterations increasing or reducing the territory sought to be annexed have
been made after the petition had been signed by any owner of real and personal property in such
territory; and
VVHEREA.S, ARS. § 9-471(L) rec~uires the Town to adopt transitional zoning classifications
which permit densities no greater than those pernutted by the county before annexation; and
WHEREAS, the zoning classification on the property prior to annexation was "Zone CB-2"
(General Business), "Zone SH" (Suburban Homestead), "Zone CI-2" (General Industrial) and "Zone
GR 1" (Rural Residential) and the most comparable town zoning classifications which do not permit
greater densities and use are "Zone VC" (Village Commercial), "Zone R-36" (Single Family
Residential, minimum loi s~ze 36,OQ~;, "Zone HI" (Heav_y Industrial, and "Zone R-36" (Single
Family Residential, minimum lot size 36,000), respectively; and
WHEREAS, the provisions of A.R.S. Section 9-471, and amendments thereto, have been
fully observed; and

WHEREAS, proper and sufficient certification and proof of the foregoing facts are now on
file in the office of the town clerk of the Town of Marana, together with a true and correct copy of
the original petition referred to herein, which is on file in the office of the county recorder.
NOW THEREFORE, BE IT ORDAINED by the Mayor and Council of the Town of Marana,
Arizona, as follows:
1. Theterritory known as TEP/I-10 annexation as reflected on Exhibit "A" attached hereto
is annexed to the Town of Marana and that the present corporate limits are extended and increased

2. That a copy of this Ordinance, together with an accurate map of the territory hereby
annexed to the Town of Marana, certified by the Mayor of said Town, be forthwith filed and
recorded in the office of the County Recorder of Pima County, Arizona.
3. The zoning classification of the territory reflected on Exhibit "A" is hereby changed from
"Zone CB-2" (General Business), "Zone SH" (Suburban Homestead), "Zone CI-2" (General
Industrial) and "Zone GR-1" (Rural Residential) to the most comparable town zoning classifications
which are "Zone VC" (Village Commercial), "Zone R-36" (Single Family Residential, minimum
lot size 36,000), "Zone HI" (Heavy Industrial, and "Zone R-36" (Single Family Residential,
minimum lot size 36,000), respectively.
~ PASSED AND ADOPTED by the Mayor and Council of the Town of Marana, Arizona, this
27th day of August, 1996.
