C. APPROVAL OF AGENDA
Motion: Approve, Moved by Council Member Carol McGorray, Seconded by Council
Member Russell Clanagan. Motion carried, 7-0.
D. CALL TO THE PUBLIC

E. PRESENTATIONS -
1. Introduction: Superior Court Judge Jan Kearny, who was appointed by the
Supreme Court to serve as Marana's Chief Magistrate Pro-Tempore
Deb Thalasitis introduced Marana's Chief Magistrate Pro-Tempore, Superior Court
Judge Jan Kearny to Council. Judge Kearny addressed Council and was welcomed to
the Town by the Mayor and Council.

2. Introduction: Assistant Utilities Director, Dorothy O'Brien
Brad DeSpain introduced the new Assistant Utilities Director Dorothy O'Brien to
Council. Ms. O'Brian addressed Council and was welcomed to the Town by the Mayor.

F. COUNCIL ACTION:
1. Resolution No. 2008-62: Relating to Municipal Court; approving and
authorizing a recruitment and selection process for Town Magistrate; and
declaring an emergency
Deb Thalasitis presented this item to Council. Recommended requirements by
Ms. Thalasitis are: salary range of $90,000 - $102,000; Juris Doctor (JD) degree;
membership in the State Bar of Arizona; ten. years' experience as an attorney,
judge or hearing officer; no prior removal for cause from a judicial position;
experience in criminal and/or traffic cases in Arizona, and experience in
managing staff in a judicial or legal environment. Mayor Honea asked why our
high end of the salary range is at $102,000, when the study done on average
salaries is $101,000. Ms. Thalasitis said the study showed the median salary
range for magistrate at $101,642, so she rounded up to $102,000. Mayor Honea
asked why the range wouldn't be $110,000, given you get the most qualified
person, they would only make the average salary. Ms. Thalasitis stated that the
range can be changed per Council direction.
Motion: Approve, Moved by Council Member Russell Clanagan, Seconded by
Council Member Carol McGorray. Motion carried, 7-0.
2. Resolution No. 2008-63: Relating to Administration; approving and
authorizing an appropriation from the town's contingency fund to the
budget of the Office of the Town Manager for travel and expenses related to
the All-American Cities competition; approving the receipt of unanticipated
revenue from community sponsorships for the All-American Cities
competition; and declaring an emergency
Gilbert Davidson presented this item to Council on behalf of Mike Reuwsaat.
Mr. Davidson is seeking $29,099 in both direct and indirect costs as well as to
accept community and business donations to help offset some of the Town's
costs. Rodney Campbell addressed Council, and gave a detailed description
about the All-American Cities competition to be held from June 4 -June 6 in
Tampa, Florida. Members of the delegation introduced themselves to Council:
Paul Bigelow (Texas Roadhouse), Lt. Roberto Jimenez (Marana Police
Department), T. VanHook (Town of Marana), Kristin Bourget (Marana High
School), David Martinez III (Arizona board of Regents, Marana High School
graduate), and Mayor Honea.

Members not in attendance are: Chuck and Dominique Aquilina, Monica
Valdenegro and Rebecca Kunsberg. Council Member Clanagan asked who the
contributions would be coming from and how much they are giving. Mr.
Davidson responded that they are still waiting on numerous businesses to respond
to the Town. Council Member Clanagan said that if the Council is to approve
this, that the Town should foot the bill for something that will benefit the Town.
Council Member Clanagan also went on to say that this is a good program but
would have liked to have been informed sooner as to the Town's involvement in
the All-American Cities Award. Council Member Comerford commended
Rebecca Kunsberg for her hard work and for getting Marana into the All-
American Cities competition.
Motion: Approve, Moved by Council Member Carol McGorray, Seconded by
Council Member Patti Comerford. Motion carried, 7-0.
G. EXECUTIVE SESSIONS:
1. Executive Session pursuant to A.R.S. §38-431.03 (A)(3), Council may ask for
discussion or consultation for legal advice with the Town Attorney
concerning any matter listed on this agenda.
2. Executive Session pursuant to A.R.S. § 38-431.03(A)(3),(4) and (7), discussion
or consultation for legal advice with the Town's attorneys and discussion and
to consider its position and instruct the Town Manager and staff concerning
the lawsuit entitled Town of Marana v. Pima County/Pima County v.
Marana (consolidated), Maricopa County Superior Court No. CV2008-
001131.
3. Executive Session pursuant to A.R.S. § 38-431.03(A)(4) and (7) to consider
the Town's position and instruct its representatives regarding negotiations
for the purchase of property rights needed for the Twin Peaks interchange
project, CIP number 2001-44, from the parcels of property generally
identified as Pima County Assessor's parcel numbers 226-15-018D, 226-15-
008B, 226-15-017B, 226-15-018B and 226-15-019A, and to instruct the
Town's attorneys in settlement negotiations and contemplated condemnation
proceedings relating to the same property rights.
H. FUTURE AGENDA ITEMS
Council Member Ziegler asked that an update on the DeAnza project be brought to
the next meeting. Council Members Comerford and Post concurred.
