MARANA ORDINANCE NO. 96.35
AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF MARANA, ARIZONA,
AMENDING CHAPTER 14, SECTION 14-2-3 OF THE MARANA TOWN CODE AMENDING
THE METHOD BY WInCH TERMS OF OFFICE ARE DETERMINED FOR THE WATER
UTILITY ADVISORY COMMITTEE AND REPEALING ALL RESOLUTIONS, ORDINANCES
AND RULES OF THE TOWN OF MARANA IN CONFLICT THEREWITH.
WHEREAS, the Town of Marana did adopt Chapter 14 of the Marana Town Code on
February 6, 1996, which outlined regulations for water, water resources and water utilities within
the town limits of Maran a; and
WHEREAS, the Mayor and Council desire to amend Chapter 14, Section 14-2-3 of the
Marana Town Code by amending the method by which tenns of office are determined for the Water
Utility Advisory Committee and have determined that the adoption of the amendment is in the best
interests of the citizens of the Town of Mar ana.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Town of
Marana, Arizona, that:
Section 1: Section 14-2-3(C) of the Marana Town Code is amended, with additions shown by
.- CAPITAL LETTERS and deletions shown by strikeout, as follows:
Section 14-2-3
Water Utility Advisory Committee
C. Membership Composition: Tenns and Oualifications. The Marana Water Utility
Advisory Committee shall be composed of seven members, two of whom shall be
residential customers, one of whom shall be a commercial customer, one of whom
shall represent agricultural interests and three of which shall represent areas of the
town at large. Members of the water utility advisory committee shall serve tenns of
three years, which tenns shall be staggered. The initial members of the water utility
advisory committee shall draw lots to determine which FOUR fIH:ee members shall
have an initial tenn of one year and which THREE twe members shall have an initial
tenn of three years. Thereafter members shall serve tenns of three years.
Section 2. All ordinances and parts of ordinances in conflict with the provisions of this ordinance
are hereby repealed, effective as of the effective date of this ordinance.
Section 3. Repeal of all ordinances and parts of ordinances in conflict with the provisions set forth
herein does not affect rights and duties that have matured or penalties that were incurred and
proceedings that were begun before the effective date of that repeal.

Section 4. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any
reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,
such decision shall not affect the validity of the remaining portions thereof
