WHEREAS the Marana Municipal Court desires to accept and process bail bonds at the Pima County Adult Detention Center for Marana Municipal Court cases; and .WHEREAS the Pima County Sheriffs Department provides staffto accept cash and surety bail bonds at the Pima County Adult Detention Center for various municipalities in Pima County and to disburse the funds to the appropriate judicial authority, thereby establishing a centralized bail bond acceptance service at the jail; and . WHEREAS the Town of Marana entered into an intergovernmental agreement with Pima County and other surrounding municipalities in June 2007 for the establishment of the bail bond ac- ceptance service. at the Pima County Adult Detention Center; and WHEREAS the: Mayor and Council of the Town of Marana feel it is in the best interests of its citizens to execute an amendment to this intergovernmental agreement. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, AS FOLLOWS. SECTION 1. The amendment to the intergovernmental agreement between the Town of Ma- rana and Pima County, the City of Tucson, the Town of Oro Valley, the City of South Tucson and the Town of Sahuarita attached to and incorporated by this reference in this resolution as Exhibit A is hereby approved, and the Mayor is hereby authorized to execute it for and on behalf of the Town of Marana. ~~l SECTION 2. WHEREAS, the Town of Sahuarita may contract for services and enter into agreementswith the County and other municipalities for joint or cooperative action pursuantto A.R.S. §11-952, et seq. ; and. WHEREAS, the Town of Sahuarita operates a municipal court, and as part of the court functions, it is necessary to accept and collect bail bonds, which service has historically been provided by the Clerk of Superior Court; and WHEREAS, in July of 2007, the Clerk of Superior Court has ceased to provide this service and all of the courts of lower jurisdiction entered into a collective agreement establishing a centralized bail bond acceptance service provided by Pima County; and WHEREAS, on May 29, 2007, by adoption of Resolution No. 2007-33, the Mayor and Council of the Town of S ahuarita authorized the Town to enter into an Intergovernmental Agreement providing for centralized bail bond acceptance. service; and WHEREAS, the Mayor and Council have determined that extension of said lntergovernmental Agreement, a copy of which is attached hereto as Exhibit "A" and incorporated herein by this reference, is in the best interests of the Town of Sahuarita and its citizens. (R) Og- 45 WHEREAS, the Town of Oro Valley is a political subdivision of the State of Arizona vested with all associated rights, privileges and benefits and is entitled to the immunities and exemptions granted municipalities and political subdivisions under the Constitution and laws of the State of Arizona and the United States; and WHEREAS, pursuant to A.R.S. § 11-952, Pima County and the Town of Oro Valley may contract for services and enter into agreements with one another for joint or cooperative action; and EREAS, on June 20, 2007, Mayor and Council approved Resolution 1Vo. (R) 07-75, authorizing the Town to enter into an Intergovernmental Agreement with Pima County, the City of Tucson, the Town of Marana, the City of South Tucson and the Town of Sahuarita for a Centralized Bail Bond Acceptance Service; and WHEREAS, the Intergovernmental Agreement can be extended for four (4) additional one (1) year periods by formal written amendment executed by the Parties; and WHEREAS, the Town wishes to extend the Intergovernmental Agreement for a term of one (1) year beginning July 1, 2008 through June 30, 2009; and WHEREAS, it is in the best interest of the Town to enter into an extension of the Intergovernmental Agreement, attached hereto as Exhibit "A" and incorporated herein by this reference, to continue providing a single location for the centralized bail bond acceptance service. NOW, THEREFORE, EE IT RESOLVED by the Mayor and Council of the Town of Oro Valley, Arizona, that: 1. The extension of the Intergovernmental Agreement between Pima County, the City of ~. THEREFORE RE IT RESOLVED by the Mayor and Council of the City of South Tucson, Arizona, that the City hereby gives formally approves and adopts Amendment l to the original IGA as presented, provides authorization for the execution of said Amendment l and empowers the Mayor of the City of South Tucson to execute said dacument.
