HomeMy WebLinkAboutOrdinance 96.45 Changing the zoning at Thornydale Road and Orange Grove Road " !! ,.f"-' MARANA ORDINANCE NO. 96.45 AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA, CHANGING THE ZONING OF CERTAIN PROPERTY LOCATED AT THE SOUTHEAST CORNER OF THORNYDALE ROAD AND ORANGE GROVE ROAD FROM "ZONE R-36" (SINGLE FAMILY RESIDENTIAL, MINIMUM LOT SIZE 36,000 SQUARE FEET) AND "ZONE RV' (RECREATIONAL VEIllCLE) TO "ZONE HI" (REA VY INDUSTRY). WHEREAS, Radnor Orange Grove Corporation is the owner of a parcel of land located at the southeast comer of Thomydale Road and Orange Grove Road, Assessor's Parcel Number 101- 23-360B, within Section 8 T13S, R13E; and WHEREAS, the applicant, O'Rielly Motor Co., has applied to the Town of Maran a to change the zoning of this property from "Zone R-36" (Single Family Residential, minimum lot size 36,000 square feet) and "Zone RV' (Recreation Vehicle) to "Zone ill" (Heavy Industry); and WHEREAS, the Marana Planning Commission held a public hearing on the rezoning request on November 20, 1996, and following this public hearing voted 6-0 to recommend that the Town Council approve the request for rezoning of the property located at the southeast comer of Thomydale Road and Orange Grove Road from "Zone R-36" (Single Family Residential, minimum lot size 36,000 square feet) and "Zone RV' (Recreational Vehicle) to "Zone HI" (Heavy Industry); - and WHEREAS, the Town Council of the Town of Maran a held a public hearing on the rezoning request on December 3, 1996, to obtain public input on the request for a change of zoning, and heard from staff, the representative of the owner, and members of the public, and has determined that the rezoning request should be approved. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Town of Maran a, Arizona that: Section 1. The zoning of that certain property located at the southeast comer of Thomydale Road and Orange Grove Road, more particularly described in Exhibit A attached hereto, is hereby changed from "Zone R-36" (Single Family Residential, minimum lot size 36,000 square feet) and "Zone RV' (Recreational Vehicle) to "Zone HI" (Heavy Industry), subject to the following condition: 1. Development of parcels A and B, as designated on the attached Exhibit A, shall be limited to commercial retail uses. Section 2. All Marana ordinances, resolutions, or motions and parts of ordinances, resolutions, or motions of the Council in conflict with the provisions of this ordinance are hereby repealed, effective as of the effective date of this ordinance. .- Marana, Arizona Ordinance 96.45 Page 1 of2 ,,:_ Section 3.
