AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF MARANA, ARIZONA
ADDING A CERTAIN SECTION TO TITLE 19, GRADING AND HELATED SITE
WORK AND TO TITLE 21 FLOODPLAIN MANAGEMENT CODE REGARDING REMOVAL
OF NATI~-E lrEGETATION-
WHEREAS the Town Council of the Town of Marana, Arizona did
on the 16th day of January 1990 adopt ordinance 90.03 adding to
the Town Development Code a new Title 19, Grading and Related
Site Work and did on the 17th day of April 1990 adopt Ordinance
90.13 adding to the Town Development Code a revised Title 21,
Floodplain and Erosion Hazard Management Code, and,
W~EREAS the Town Council does wish to amend and to add to
each'Title.
NOW, THEREFORE BE IT 0RDAINED by the Town Council of the
Town of Marana, Arizona that the following addition to Title 19
and Title 21 be adopted by this ordinance to become part of the
Development Code.
1. A new 19.040 M and a new 21.09 B 6 be added to read:
Removal of native vegetation
In order to minimize erosion and sedimentation in the l~n
off from the Tortolita mountains, native vegetation shall not be
removed from that part of the Town of Marana East of 1-10 except
where the Town Engineer has approved the methods to control
erosion, sedimentation, flow and related factors and their imple-
mentation is assured by a mutual consent agreement between the
Town and the applicant signed and guaranteed by cash or a bond
acceptable to the Town Attorney in an amount set by the Town
Manager to guarantee performance of the provisions of the mutual
consent agreement.
WHEREAS, the immediate operation to this Ordinance is
necessary for the preservation of the public peace, health and
safety of the Town of Marana, an emergency is hereby declared to
exist, and this Ordinance shall be in full force and effect from
and after its passage, adoption and approval by the Town Council
of the Town of Marana.
PASSED AND ADOPTED by the Town Council of the Town of Mara-
na, Arizona this 20th day of August, 1991.
