AN ORDINANCE OF THE TOWN OF MARANA, ARIZONA RELATING TO THE
CIRCULATION OF REFERENDUM AND INITIATIVE PETITIONS

referendum powers; and
WHEREAS, the Town Council
WHEREAS, Article IV of the Arizona Constitution and
Section 19-141(A) allows the Town to
exercising initiative and

Arizona has determined it to be in the best interests of the Town
to limit the circulation of referendum and initiative petitions
to qualified electors within the Town, and to provide further for
the manner of exercising the right to initiative.
NOW, THEREFORE, BE IT ORDAINED by the Town Council of
the Town of Marana, Arizona as follows:
1. That no person shall circulate an initiative or
referendum petition relating to a Town issue unless that person
is a qualified elector within the Town of Marana.
2. In determining the number of signatures required to
file an initiative petition, the computation shall be based upon
the total number of electors of the Town of Marana registered to
vote on the date that the initiative petition is filed with the
Town Clerk.
3. This Ordinance and the various parts, sections and
clauses thereof are hereby declared to be severable. If any
part, section, paragraph, sentence, clause or phrase is adjudged
to be unconstitutional or invalid, it is hereby declared that the
remainder of this Ordinance shall not be effected thereby.
WHEREAS, the immediate operation of this Ordinance is
necessary for the preservation of the public peace, health and
safety of the Town of Marana, Arizona, an emergency is hereby
declared to exist, and this Ordinance shall be in full force and
effect from and after its passage and adoption.
PASSED AND ADOPTED by the Mayor and Council of the Town
of Marana, Arizona this 1st day of August, 1989.
