HomeMy WebLinkAboutOrdinance 89.31 Amending Ordinance 77.9 by adding a severability and penalty clauseORDINANCE NO. 89. 31 AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF MARANA, ARIZONA AMENDING ORDINANCE NUMBER 77.9 BY ADDING A SEVERABILITY CLAUSE AND PENALTY CLAUSE WHEREAS the Town Council of the Town of Marana, Arizona did, on the 6th day of September, 1977 pass Ordinance No. 77.9 providing for the licensing and regulation of massage parlors and bathhouses within the Town limits; and WHEREAS the foregoing Ordinance contains neither a severability clause nor a penalty clause; and WHEREAS the Town Council has deemed it to be in the best interests of the Town for the foregoing licensing and regulation Ordinance to contain both a severability and a penalty clause. NOW, THEREFORE, BE IT ORDAINED by the Town Council of the Town of Marana, Arizona as follows: 1. That Ordinance Number 77.9 be amended to contain the following Section 12: "If any provision of this Ordinance or its application to any person or circumstance is held invalid or unconstitutional, the invalidity or unconstitutionality does not affect other provisions or applications of this Ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this Ordinance are severable." 2. That the following Section 13 be added to Ordinance Number 77.9: "Section 13. Any violation of this Ordinance shall constitute a Class 1 Misdemeanor." WHEREAS the immediate operation of this Ordinance is necessary for the preservation of the public peace, health and safety of the Town of Marana, Arizona, an emergency is hereby declared to exist, and this Ordinance shall be in full force and effect from and after its passage and adoption.
