AN ORDINANCE PROHIBITING URINATING AND DEFECATING
IN PUBLIC
WHEREAS the Town Council is empowered to prevent,
suppress and punish any disorderly noise or disturbance in any
public or private place within the Town; and
WHEREAS the Town Council is empowered to prohibit and
punish any practice tending to annoy or obstruct persons passing
upon the streets or sidewalks of the Town; and
WHEREAS the Town Council is empowered to abate and
remove nuisances, and punish persons committing nuisances; and
WHEREAS the Town Council is empowered to prescribe
regulations which may be necessary or expedient for the
prevention or suppression of disease; and
WHEREAS the Town Council is empowered to authorize the
arrest and punishment of disorderly persons; and
WHEREAS the Town Council has determined that some
individuals have been committing public acts which the Town
Council deems to be deleterious to the Town and its residents.
NOW, THEREFORE, BE IT ORDAINED by the Town Council of
the Town of Marana, Arizona as follows:
Section 1. It shall be unlawful for any person to
urinate or defecate in a public place, or in any place exposed to
public view, except in an established lavatory or toilet.
Section 2. A violation of this Ordinance shall
constitute a Class 1 Misdemeanor.
BE IT FURTHER RESOLVED that any violation of this
Ordinance or the Code that it adopts by reference shall be a
Class 1 Misdemeanor.
BE IT FURTHER RESOLVED that if any provision of this
Ordinance or the Code that it adopts by reference or their
application to any person or circumstance is held invalid or
unconstitutional, the invalidity or unconstitutionality does not
affect other provisions or applications of this Ordinance or the
Code that it adopts by reference which can be given effect
without the invalid provision or application, and to this end the
provisions of this Ordinance and the Code that it adopts by
reference are severable.
PASSEDAND ADOPTED by the Town Council of the Town of
Mararia, Arizona this 1st day of November, 1988.
