HomeMy WebLinkAboutOrdinance 87.03 Amending Ordinance 86.11 relating to a transaction privilege tax ORDINANCE NO. 87.03 AN ORDINANCE AMENDING TOWN ORDINANCE 86.11 PROVIDING FOR THE IMPOSITION OF A TRANSACTION PRIVILEGE TAX UPON CERTAIN UTILITIES AND DELETING THE LEVY OF SAID TAX UPON INTERSTATE COMMUNICATIONS FACILITIES WHEREAS the Town of Marana did enact that certain Ordinance 86.11 on the 18th day of November 1986, which Ordinance amended Ordinance 79.03 by adding a new section thereto with respect to the levying of a transaction privilege tax upon utilities within the Town limits of the Town of Marana; and WHEREAS the Town of Marana does now wish to amend said Ordinance by deleting the imposition of said transaction privilege tax upon interstate communications facilities. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN OF MARANA THAT ORDINANCE NO. 86.11 IS HEREBY AMENDED BY DELETING SECTION 79-3(C)(2), AND BY ADDING THE FOLLOWING SECTION IN ITS PLACE: Section 79-3(C)(2). There is further levied at an amount equal to 2.0% of the gross income from the business, a tax upon every person engaged in or continuing to engage within the Town in the business of transmitting local or intrastate messages or conversations by telephone, or messages by telegraph, from within the Town, including gross income derived from any services rendered to subscribers within the corporate limits of the Town, and including gross income derived from subscribers within the corporate limits of the Town in connection with the publication of any directory. WHEREAS the immediate operation of the provisions of this Ordinance is necessary for the preservation of the public peace, health and safety of the Town of Marana, an emergency is hereby declared to exist, and this Ordinance shall be in full force and effect from and after its passage, adoption and approval by the Town Council of the Town of Marana.
