RELATING TO ZONING UPON FINAL ANNEXATION;
AND FOLLOWING COUNTY ZONING
UPON FINAL ANNEXATION
WHEREAS, on August 19, 1987 the Marana Town Council adopted
Ordinance 87.13 annexing into the Town of Marana certain real
property, including that real property more particularly
described on Exhibit "A" attached hereto and incorporated herein
by this reference; and
WHEREAS, pursuant to A.R.S. 9-471 (D), the annexation of
the real property described on Exhibit "A" attached hereto (The
Acacia Hills Property") shall become effective on September 19,
1987; and
WHEREAS, as of the date hereof, Pima County zoning remains
in effect on the Acacia Hills Property; and
WHEREAS, the Mayor and Town Council of the Town of Marana
wish to provide for the temporary continuation of Pima County
zoning on the Acacia Hills Property following the effective date
of the annexation of the Acacia Hills Property into the Town of
Marana;
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND TOWN COUNCIL
OF THE TOWN OF MARANA, ARIZONA, AS FOLLOWS:
SECTION 1. That pursuant to A.R.S. 9-462.04 (D), following
the effective date of the annexation of the Acacia Hills Property
and until Town zoning districts have been established for the
Acacia Hills Property, existing Pima County zoning currently
applicable to the Acacia Hills Property shall continue in effect.
SECTION 2. That it is necessary for the preservation of the
peace, health and safety of the Town of Marana that this
ordinance become immediately effective, an emergency is hereby
declared to exist, and this ordinance shall become effective
immediately upon its passage and adoption.
