AN ORDINANCE AMENDING THE DEVELOPMENT CODE
FOR THE TOWN OF MARANA, ARIZONA,
BY AMENDING TITLES 3, 5, AND 8.
WHEREAS the Town of Marana currently has
and effect a Town Development Code and other Codes,
and Regulations; and
WHEREAS the Town of Marana
the necessary Public Hearing; and
WHEREAS the Planning Commission has recommended that
the Town Council adopt the following changes to the Town
Development Code; and
WHEREAS all the require steps of the Town Development
Code have been followed.
NOW, THEREFORE, BE IT ORDAINED by the Town Council of
the Town of Marana that the Town Development Code be amended as
follows:

Planning Commission has held
Section 03.02 Definitions
Significant Change in Land Use - (3) change the nature of any
business, industrial, or quasi-public use of the land (including
agricultural use) to any use that would fall in a different
Standard Industrial Classification at the major group level,
except where such other use is already in existence on land
immediately adjacent to the site of the proposed change;
Section 05.03.01 Notification of Intended Land Use Change
Add the following sentence:
The landowner or lessee undertaking the proposed land use change
shall provide the Planning and Zoning Administrator with a copy
of the list and map used to notified the property owners per this
section prior to undertaking the proposed land use change.
Section 05.03.02 Protest
Change the section to read:
If owners of a real property interest immediately adjacent to the
lot or parcel for which a significant land use change has been
proposed, or if more than 25 percent of the owners of nearby
property as defined in Title 3 to this code, or if by affirmative
motion by the Planning Commission or Town Council protest the
proposed land use change in writing to the Town Clerk within
thirty (30) days of their receipt of notification of said change,
then the landowner or lessee proposing the change must proceed
per 05.03.03 of this Code. If none of the above situations
occur the landowner or lessee proposing the change may proceed
with the intended change without further approval from the Town,
except as may be required under other sections of this Code or by
other ordinances of the Town of Marana.
Section 05.03.03 Response to Protest
The percentage would change from 8 to 25 percent.
Section 05.03.04 Decision by the Planning Co~ission
The percentage would change from 20 to 25 percent. Also the last
sentence would have entl~e ~e~erehip o2 the dropped.
Section 08.02 ADOPTION OF THE UNIFORM BUILDING, PLUMBING, AND
ELECTRICAL CODES, WITH EXCEPTIONS.
add the following sentence:
In the event of an inconsistency between the Town Development
Code and the Uniform Building Code, National Electrical Code or
Uniform Plumbing Code, then and in the event the Marana Town
Development Code shall prevail.
Section 08.04.01 Basic
Reword to read:
Building permit fees to
Code, current edition.
Permit Application Fee
be as prescribed in the Uniform Building
Section 08.04.02 Plans Check Fee
Reword to read:
Plan review fees to be as prescribed in the
Code, current edition.
All the other sub-sections of 08.04.02 will
Uniform Building
be dropped.
PASSED AND ADOPTED by the Town Council of the Town of
Marana, Arizona this 3rd day of November, 1987.
