AN ORDINANCE PROVIDING FOR THE PAYMENT OF FEES TO OFFSET
THE COSTS OF ANNEXATION PROCEEDINGS
WHEREAS the Town of Marana incurs monetary costs,
including but not limited to legal fees, engineering fees, and
general administrative expenses,
annexations into the Town; and
WHEREAS the Town Council
in considering proposed
of the Town of Marana has
deemed it to be in the best interests of the existing residents
of the Town to provide for a fee schedule for properties which
wish to be annexed into the Town; and
WHEREAS the Town Council has determined that the
minimum cost to the Town in considering proposed annexations
costs approximately $500.00; and
WHEREAS the Town Council has determined that the larger
a proposed parcel to be annexed into the Town is, the more costs
are involved in reviewing said proposed annexations.
NOW, THEREFORE, BE IT ORDAINED by the Town Council of
the Town of Marana, Arizona as follows:
Section 1. That each requested annexation into the
corporate limits of the Town of Marana shall, upon the
presentation of said petition or petitions to the Planning and
Zoning Commission of the Town of Marana, be accompanied by a
nonrefundable fee as set forth herein.
Section 2. That the fees charged hereunder shall be in
the amount of $5.00 per acre (or portion thereof), the total
number of acres to be determined by the legal description as
contained in the petition for annexation, provided however that
in no event shall the fees to be charged hereunder be less than
$500.O0.
Section 3. That the fees charged hereunder are to
offset the costs to the Town of Mararia in reviewing the
annexation proposals and petitions, are nonrefundable, and are
not to be contingent upon the acceptance or rejection of the
petition or petitions or ultimate annexation by the Town Council.
Section 4. That the fees charged hereunder are
exclusive of any and all other fees charged by the Town,
including but not limited to building permit fees, franchise
fees, fees for plan reviews, and any other fees, taxes or levies
charged by or collected by the Town.
Section 5. If any provision of this Ordinance or its
application to any person or circumstance is held invalid or
unconstitutional, the invalidity or unconstitutionality does not
affect other provisions or applications of this Ordinance which
can be given effect without the invalid provision or application,
and to this end the provisions of this Ordinance are severable.
Section 6. WHEREAS the immediate operation of this
Ordinance is necessary for the preservation of the public peace,
health and safety of the Town of Marana, Arizona, an emergency is
hereby declared to exist, and this Ordinance shall be in full
force and effect from and after its passage, adoption and
approval by the Town Council of the Town of Marana.
PASSED AND ADOPTED by the Town Council of the Town of
Marana, Arizona this 1st
