HomeMy WebLinkAboutOrdinance 86.05 Screening of inoperable or unlicensed motor vehicles on residential lotsORDINANCE NO. 86.05 AN ORDINANCE REQUIRING THAT INOPERABLE OR UNLICENSED MOTOR VEHICLES ON RESIDENTIAL LOTS BE SCREENED FROM VIEW WHEREAS, the presence of inoperable and unlicensed motor vehicles on residential lots in the Town of Marana has created conditions in some residential areas that are considered unsightly, hazardous, and detrimental to the general welfare of the people of the Town, and WHEREAS, the Marana Town Council did, on the 9th day of August 1982, pass Ordinance No. 82.04, which Ordinance the Town Council now wishes to rescind and replace with the following Ordinance. NOW THEREFORE, be it enacted by the Town Council of the Town of Marana, Arizona, that: 1. Where any inoperable or unlicensed motor vehicle or major component of a motor vehicle is stored on a residential lot in the Town of Marana for more than thirty (30) days, said vehicle, vehicles or major components shall be hidden from the view of individuals standing at ground level from adjacent lots and streets by an ap- propriate fence, wall, or landscaping. 2. A major component of a motor vehicle shall be considered to be a car or truck body, or parts thereof with or without wheels, a car or truck chassis, or an engine block, or transmission, or axle with or without any ancillary fixtures. 3. A residential lot shall be defined as any lot on which a residence exists, as defined by the Town's Development Code, or any vacant lot adjacent to one or more lots on which a residence exists. 4. It shall be a Class I Misdemeanor for any property owner or renter to cause or knowingly permit the storage on property under his control of a inoperable or unlicensed motor vehicle or vehicles or major components of a motor vehicle for more than thirty (30) days without screening those items from view as required in paragraph 1 of this Ordinance. Each day of violation shall be considered as a separate offense~ and each such vehicle or component shall also con- stitute a separate offense. 5. Ordinance No. 82.04 is hereby rescinded. WHEREAS the immediate operation of this Ordinance is necessary for the preservation of the public peace, health and safety of the Town of Marana, an emergency is hereby declared to exist, and this Ordinance shall be in full force and effect from and after its passage, adoption and approval by the Town Council of the Town of Marana.
