HomeMy WebLinkAboutOrdinance 86.11 Amending Ordinance 79.03 relating to a transaction privilege tax on utilities ORDINANCE NO. 86.11 AN ORDINANCE AMENDING TOWN ORDINANCE 79.03 PROVIDING FOR THE IMPOSITION OF A TRANSACTION PRIVILEGE TAX UPON CERTAIN UTILITIES WHEREAS the Town of Marana did enact that certain Ordinance 79.03 on the 20th day of November 1979; and WHEREAS the Town of Marana does now wish to amend said Ordinance by adding a new Section thereto with respect to the levying of a transaction privilege tax upon utilities within the Town limits of the Town of Marana; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN OF MARANA THAT ORDINANCE NUMBER 79.03 IS HEREBY AMENDED BY ADDING SECTION 79-3(C), TO READ AS FOLLOWS: Section 79-3(C) - Taxation of Utilities. 1. There is further levied at an amount equal to 2.Q% of the gross income from the business, a tax upon every person engaging or continuing to engage within the Town in the business of furnishing to consumers within the Town electricity, electric lights, current, power, gas (natural or artificial) or domestic water. 2. There is further levied at an amount equal to 2.0% of the gross income from the business, a tax upon every person engaged in or continuing business of transmitting conversations by telephone, the Town to another point to engage within the Town in the local or long distance messages or or messages by telegraph, from within in the Town, within the State, or outside of the State, including gross income derived from any services rendered to subscribers within the corporate limits of The Town and including gross income derived from subscribers within the corporate limits of the Town in connection with the publication of any directory. 3. In computing the amount of tax imposed under Sections C1 and C2 above, there shall be allowed as an offset against this tax full credit for any and all franchise fees paid to the Town pursuant to the terms of a franchise by anyone engaged in and holding a Town franchise for any of the businesses heretofore described, such franchise fees to include all fees and payments made which are based on gross income realized from sales or services provided to specified classes of customers within the Town.
