AN ORDINANCE Ab~NDING THE TOWN ZONING ORDINANCE TO CHANGE THE ZONES TO k~ICH
LAND IN SECTION 36, TO~SHIP 11 SOUTH, RANGE 11 EAST, IS ASSIGNED, PROVIDING
FOR THE IMPOSITION OF CERTAIN CONDITIONS ON THE USE OF SAID LAND, AND DECLARING
AN E~RGENCY.
WHEREAS, the owners of land in Section 36, Township 11 South, Range 11 East,
Gila and Salt River Base and Meridian, within the Town of Marana, Pima County,
have petitioned the Marana Town Council to amend the Town Zoning Ordinance to
change the zones within which said land has been placed; and
WHEREAS, a public hearing has been held on said request, and nearby property
owners have been notified of the request in accordance with the provisions of
the Town Zoning Ordinance,
NOW THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE TOWN OF MARANA THAT:
(1) the portion of the northeast ¼ of Section 36, Township 11 South, Range 11
East, Gila and Salt River Base and Merdian, containing approximately 61.7 acres,
as indicated on the attached map, which is made a part of this ordinance, shall
be placed in Zone C as defined by the Zoning Ordinance of the Town of Marana.
(2) Paragraph (19) of Section 04.03.01 of the Town Zoning Ordinance shall be
deleted.
(3) Section 04.03.02 of the Town Zoning Ordinance shall be amended to include
a Paragraph (4), which shall read: THAT PART OF THE g~EST ½ OF THE NORTHWEST
¼ OF SECTION 36, TOWNSHIP 11 SOUTH, RANGE 11 EAST, LYING SOUTHinEST OF INTERSTATE
10 AND CONTAINING APPROXIbt~TELY 24 ACRES, AS INDICATED ON THE ACCOMPJ31YING MAP,
~ICH IS MADE A PART OF THIS ORDINANCE.
(4) Section 04.03.02 of the Town Zoning Ordinance shall be amended to include
a Paragraph (5), which shall read: THE %~ST 800 FEET OF THE SOUTH 1,100 FEET
OF THE SOUTHEAST ¼ OF THE SOUTHWEST ¼ OF SECTION 36, TOWNSHIP 11 SOUTH, RANGE
11 EAST, AS SHOI~ ON THE ACCOMPANYING ¥~P, WHICH IS bigDE A PART OF THIS ORDINANCE.
(5) Section 04.03.05 of the Town Zoning Ordinance shall be amended to add the
following: AS WELL AS ALL OF THE SOUTHEAST ¼ OF SECTION 36, TOWNSHIP 11 SOUTH,
RANGE 11 EAST, AND THOSE PORTIONS OF THE I~ST ½ OF SECTION 36, TO~SHIP 11 SOUTH,
RANGE 11 EAST, INDICATED ON THE ACCOMPA/~YING MAP, WHICH IS M~ADE A PART OF THIS
ORDINANCE.
(6) Before any building permit or certificate of occupancy or zoning compliance
shall be issued for the land in Section 36, Township 11 South, Range 11 East, G
& S R B & M, the owner or lessee of said land shall:
A. construct a fence or wall no less than 42 inches nor more than 72 inches in
height, with the 72-inch height being required where dwelling unit density on
adjacent land is greater than six (6) units per acre, along the southwest right-
of-way line of the irrigation canal easement of the Cortaro-Marana Irrigation
District that parallels Interstate 10 on its southwest side, and the north right-
of-way line of the irrigation canal easement of the Cortaro-Marana Irrigation
District that runs along the north side of Tangerine Road, except where said
irrigation canals are covered.
B. agree to include in each rental or sales agreement for residential, commercial,
or industrial land or space within Section 36, Township 11 South, Range 11 East,
a provision that the owner, buyer, lessee, renter, or user of said land or space
acknowledges the right of owners of land within one-half mile of said Section 36
to conduct farming operations using methods and equipment, including soil prep-
aration and pest control methods, for the growing of crops in accordance with
Arizona law.
C. obtain specific approval of the appropriate Town of Marana, Pima County, and
State of Arizona authorities for the location and design of any waste water treat-
ment facilities located within Section 36, Township 11 South, Range 11 East.
D. assure and provide evidence of compliance with the provisions of Paragraph
07 of the Town Building Code Ordinance, Ordinance 77-10, or any similar provision
of any successor ordinance of the Town of Marana regarding the drainage of surface
waters, for any development.
(7) This ordinance and the various parts, sections and clauses are hereby declared
to be severable. If any part, section, paragraph, sentence, clause, or phrase
is adjudged unconstitutional or invalid, it is hereby declared that the remainder
of the ordinance shall not be affected thereby. The Town Council hereby declares
that it would have passed this ordinance and each part, section, clause, and
phrase thereof, irrespective of the fact that any one or more portions thereof
be declared invalid.
(8) In consideration of impending development, in the opinion of the Town Council
an emergency exists. This ordinance shall therefore be in full force and effect
from and after its passage by the Town Council.
