A RESOLUTION TO THE MAYOR AND TOWN COUNCIL OF THE TOWN OF MARANA,
ARIZONA, AUTHORIZING THE TOWN TO ENTER INTO A LAND EXCHANGE WITH
ARIZONA PAVILIONS, INC.
WHEREAS, the Town of Marana owns a 48 Acre District Park site in sections 34 & 35 of
Township 12 South, Range 12 East; and
WHEREAS, Arizona Pavilions, Inc., owns land adjacent to the Town's 48 Acre District Park
site in sections 34 & 35 of Township 12 South, Range 12 East; and
WHEREAS, the Town and Arizona Pavilions, Inc., desire to develop new public and private
infrastructure and parks to meet the public facilities and commercial demands that are occurring as a
consequence of increasing population; and
WHEREAS, the Town and Arizona Pavilions, Inc., desire to develop their respective
properties in as efficient a manner as possible; and
WHEREAS, the Town and Arizona Pavilions, Inc., will derive the benefit of greater design
and land utilization efficiency if their common boundary is more linear; and
WHEREAS, the Town and Arizona Pavilions, Inc. will both retain land areas in an amount
equal to their original holdings after conclusion of a land exchange initiated to establish a more
linear common boundary; and
WHEREAS, the Mayor and Council of the Town of Marana have determined that the land
areas to be exchanged are equal in value, and that exchanging such lands is in the best interests of the
Town and its residents.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Marana,
Ahzona, that the Mayor is authorized to execute a Land Exchange Agreement with Arizona
Pavilions, Inc., for the purposes of establishing a more linear common boundary, and convey to
Arizona Pavilions, Inc. 15,111 Square feet of land in sections 34 & 35 of Township 12 South, Range
12 East.
