HomeMy WebLinkAboutResolution 2002-089 variance to dmn limited partnershipMARANA RESOLUTION NO. 2002-89 A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA, ACTING AS THE BOARD OF ADJUSTMENT, GRANTING A VARIANCE TO .DMN LIMITED PARTNERSHIP FOR THE STREET FRONTAGE REQUIREMENTS OF THE "CO"Z ONING DESIGNATION OF THE MARANA LAND DEVELOPMENT CODE, FOR THEIR PROPERTY LOCATED AT 4340 W. INA ROAD, WITHIN A PORTION OF SECTION 31, TOWNSHIP 12 SOUTH, RANGE 13 EAST, ASSESSOR'S PARCEL NUMBER 225-37-3750. WHEREAS, DMN Limited Partnership is the owner of Assessor's Parcel Number 225- 37-3750, located at 4340 W. Ina Road, approximately one hundred feet east of Ulene Place on the north side of Ina Road, and have applied to the Town of Marana for approval of a variance to the street frontage requirements for the "CO" (Commercial) zone; and WHEREAS, t he M arana T own Council, acting a s the Board of Adj,ustment, finds that strict application of the applicable Town Development Standards poses an unnecessary hardship to the owners of this property; and WHEREAS, t he M arana T own Council, acting a s the Board of AdjUstment, finds that granting the requested variance is the minimum necessary action to afford relief; and WHEREAS, the Marana Town Council, acting as the Board of Adjustment, finds that the requested variance does not allow a use which is not permitted in the zoning code; and WHEREAS, the Marana Town Council, acting as the Board of Adjustment, finds that the requested vahance will not cause injury to or adversely affect the fights of surrounding property owners; and WHEREAS, the Marana ToWn Council, acting as the Board of Adjustment, finds that the requested variance is in harmony with the general intent and purpose of the zoning code and the specific provision for which the variance is requested; and WHEREAS, A.R.S. § 9-462.06 authorizes the Marana Town Council, acting as the Board of Adjustment, to grant such a variance; and WHEREAS, the M arana Town Council, acting as the Board of Adjustment, has heard from the representatives of the owner, staff, and members of the public at the regular Town Council meeting held September 3, 2002, and has determined that the variance submitted by DMN Limited Partnership is in the best interest o f t he residents o f t he T own o fM arana a nd should be approved. Marana Resolution No. 2002-89 Page 1 of 2 NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the T own o f Marana, Arizona, acting as the Board of Adjustment, that the variance to allow a reduction in the street frontage requirement of"CO" zone for 4340 W. Ina Road is hereby approved. PASSED AND ADOPTED by the Mayor and Council of the Town of Marana, Arizona, this 3rd day of September, 2002.
