AN RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA,
ARIZONA, AMENDING THE FUTURE DEVELOPMENT PLAN MAP WITHIN THE
MARANA GENERAL PLAN, CHANGING THE LAND USE DESIGNATION ON
APPROXIMATELY 431 ACRES OF LAND GENERALLY LOCATED SOUTH OF THE
CAMINO DEL NORTE ALIGNMENT, WEST OF CAMINO DE OESTE, WITHIN PORTIONS
OF SECTIONS 1, 11, AND 12, TOWNSHIP 12 SOUTH, RANGE 12 AND A PORTION OF
SECTION 7, TOWNSH~ 12 SOUTH, RANGE 13 EAST, FROM LAND USE DESIGNATIONS
OF MEDIUM TO HIGH DENSITY RESIDENTIAL; COMMERCIAL: COMMUNITY; AND
OPEN SPACE: RECREATIONAL TO LOW DENSITY RESDENTIAL.
WHEREAS, The Town of Marana has made application to abandon the Specific Plan known
as the Hartman Hills Specific Plan, located in portions of Sections 1, 11, and 12, Township 12 South,
Range 12 East and a portion of Section 7, Township 12 South, Range 13 East, generally south of the.
Camino Del Norte alignment, and westerly of Camino De Oeste; and
WHEREAS, The Town of Marana has met with the owners and their representatives, and
discussed the antiquated land uses contained within the Hartrnan Hills Specific Plan, and all parties
have agreed that the properties associated with the Hartman Hills Specific Plan should be rezoned to
"R_-36" (Residential, one dwelling per 36,000 square feet); and
WHEREAS, the Marana Planning Commission, after a public h earing, considered t his
General Plan Amendment request on July 31, 2002, and voted unanimously to recommend that the
Town Council approve said Amendment; and
WHEREAS, the Marana Town Council heard from representatives of the owner, staff and
members of the public at the regular Town Council meeting held September 17 and November 5,
2002, and have determined that the Rezoning is in conformity with the Future Development Plan
Map within the Marana General Plan and should be approved, subject to recommended conditions.
WHEREAS, the Town Council has determined that the General Plan Amendment to the
Future Land Use Plan of the General Plan is desirable for the reasonable development of the Town
of Marana;

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Marana,
Arizona, as follows:
Section 1: The request from the Town of Marana to amend the Future Development Plan
Map within the Marana General Plan, changing the land use designation on approximately 431
acres of land generally located south of the Camino Del Norte alignment, west of Camino de
Oeste, within portions Of Sections 1, 11, and 12, Township 12 South, Range 12 East and a
portion of Section 7, Township 12 South, Range 13 East, from Land Use Designations Of
Medium, Medium High, and High Density Residential; Commemial/Office; Open Space/Natural
Washes, and Roads to Low Density Residential is hereby approved.
Section 2: All ordinances, resolutions, or motions and parts of ordinances, resolutions, or
motions of the Council in conflict with the provisions of this Resolution are hereby repealed,
effective as of the effective date of this Resolution.
Section 3: If any section, subsection, sentence, clause, phrase or portion of this Resolution is
for any reason held to be invalid or unconstitutional by the decision of any court of competent
jurisdiction, such decision shall not affect the validity of the remaining portions hereof.
