HomeMy WebLinkAboutResolution 2002-096 abandonment of drainage easement in continental ranch parcel 50MARANA RESOLUTION NO. 2002-96 A RESOLUTION OF THE MAYOR AND TOWN COUNCIL OF THE TOWN OF MARANA, ARIZONA, CONTINENTAL RANCH PARCEL 50 ABANDONMENT OF THE PUBLIC DRAINAGE WAY FROM APPROXIMATELY TWO-HUNDRED AND THIRTY FEET (230') EAST OF WADE ROAD. WHEREAS, Town Management has initiated the process for the abandonment of a portion of the Town's public drainage way, dedicated in the Final Block Plat of Continental Ranch Parcel 50 recorded in Book 42 at Page 54 with the Pima County Recorder's Office; and WHEREAS, the Mayor and Council have the authority pursuant to A.R.S. § 28-7202, to dispose of or use the roadways; and WHEREAS, the definition of "public right-of-way" or "right-of-way" includes; highway, street, road, alley or other right-of-way of a governmental entity as stated in ,A.R.S. § 48-4475; and WHEREAS, the Town proposes to abandon portions of the public drainage way located adjacent to and directly south of residences located within Continental Ranch Parcel 50, from lot 11 through lot 17 and lot 38 through lot 42, containing approximately 66,306 square feet, as legally described in Exhibit A and shown on the map Exhibit B; and WHEREAS, it has been determined by the Mayor and Council that a portion of the public drainage way from approximately 230 feet east of Wade Road, as recorded in Map and Plats Book 42, Page 54, as shown on the maps attached as Exhibits B incorporated herein by this reference, and legally described in attached Exhibit A, incorporated herein by this reference, is no longer necessary to the Town; and WHEREAS, notice of the intended abandonment has been posted on the property and published according to the applicable statutes; and WHEREAS, quit-claim deeds shall be recorded with the Pima County Recorder's Office quit-claiming the portions directly adjacent to James & Diane Bracken (lot 11), Nelson & Laura Bohall (lot 12), John & Ikuko Mackey (lot 13), Rafael & Luisa Hernandez (lot 14), Richard & Shirley Alworth (lot 15), Ray & Sandra Brisbine (lot 16), Richardo & Cecilia Serrano (lot 17), Sherwood Scribner (lot 38), Edwin & Kimberly Etherington (lot 39), Joselynn & Sue Ellen Villabrille (lot 40), Gordon Hershman (lot 41) and Dale & Sandra Widmer (lot 42). Marana Resolution No. 2002-96 P,.~age 1 of 2 NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Marana, Arizona, that the Town of Marana abandon a portion of the Public Drainage Way a distance of approximately 230 feet east of Wade Road, as recorded in Map and Plats Book 42, Page 54, more fully depicted in the maps attached hereto as Exhibits B and legally described in Exhibits A, incorporated herein by this reference, which is no longer necessary to the Town, subject to the following condition: · Reservation (perpetual easements) for all existing and future public utilities/sewers within the abandonment area. · Reservation (perpetual easement) for drainage and maintenance within the abandonment area.
