WHEREAS, Marana is a political snbdivision of the State of Arizona, and pursuant to Article 13, Section 7 of the Arizona Constitution, is vested with all the fights, privileges and benefits, and entitled to the immunities and exemptions ~anted municipalities and political subdivision under the Constitution and Laxvs of the State of Arizona and the United States; and V,q-IEREAS, the Metropolitan Domestic Water Improvement District (MDW1D) is seeking consent from the Town of Marana to expand their boundaries to include parcels of land construed to be noncontiguous to their current boundaries as shown in Exhibits A & B attached hereto which areas iie within six :niles of the Town boundaries; and V~HEREAS, Arizona Revised Statutes §48-902(G) requires MDWIIO to obtain the consent of the governing body of an incorporated city or town prior to expansion if the proposed boundaries ora noncontiguous district are located within six miles of the city or town; and WHEREAS, the Town of Marana has no objections to the expansion of MDWID's boundaries as shown in Exhibits A & B; NOW, THEREFORE, BE iT RESOLVED by the Mayor and Council of the Town of Marana, Arizona, that the Town of Marana consents to the expansion of MDWID's boundaries into areas noncontiguous with its current boundaries as shown in Exhibits A & B.
