HomeMy WebLinkAboutResolution 2001-023 release of substitute assurance agreements for sunset acres IIMARANA RESOLUTION NO. 2001-23 A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, APdZONA, AUTHORIZING THE RELEASE OF THE SUBSTITUTE ASSURANCE AGREEMENT BETWEEN K E & G HOMES, LLC, TITLE GUARANTY AGENCY OF ARIZONA, INC., AND THE TOWN OF MARANA FOR LOTS 1-7, 9-15, 35-39 & 42, COMMON AREAS A AND B; AND ACCEPTING FOR MAINTENANCE THE pUBLIC IMPROVEMENTS IN SUNSET ACRES 11. WHEREAS, Sunset Acres 11 is a 55.85 acre subdivision located north of Sunset Road, west of Silverbell Road containing Lots 1-7, 9-15, 35-39 & 42, Common Areas A & B, and is recorded at the Pima County R¢corder's Office in Book 53 of Maps and Plats, Page 9; and · into a Substitute Assurance Agreement with WHEREAS, the Town has prevmusly entered of Arizona, K E & G Homes, LLC, (beneficiary) under Trust No. T-1324 and Title GuarantY Agency Inc., (trustee), recorded at the Pima CountY Recorder's Office at Docket 11455, Page 1495 assuring the completion of public improvements; and E & G Homes, LLC, has completed the public improvements acceptable to WHEREAS, K Sunset Acres 1I, lots 1-7, Town standards in accordance with the Substitute Assurance Agreement for 9-15, 35-39 & 42. · of the Town of Marana NOW, THEREFORE, BE IT RESOLVED bythe Mayor and Council as follows: · inin lots 1-7, 9-15, 35-39 & 42 and Common Areas A ~t=,'Iion l. Common Areas A & B, as depicted on Exhibit A, shall be owned and maintained by an Association of Individual Lot Owners.
