A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA,
ARIZONA APPROVING THE PRELIMINARY PLAT SUBMITTED BY THE MYERS
DEVELOPMENT CORPORATION FOR TWIN PEAKS HIGHLANDS, WHICH IS A 102-
LOT SINGLE FAMILY DETACHED MANUFACTURED HOME SUBDIVISION ON 29.78
ACRES LOCATED SOUTHEAST OF THE INTERSECTION OF TWIN PEAKS ROAD AND
SILVERBELL ROAD IN A PORTION OF THE SOUTHEAST ¼ OF SECTION 20,
TOWNSHIP 12 SOUTH, RANGE 12 EAST.
x3&IEREAS, The Myers Development Corporation is the owner of the property located
southeast of the intersection of Twin Peaks Road and Silverbell Road, more particularly within
the portion of the Southeast ¼ of Section 20, Township 12 South, Range 12 East, and has applied
to the Town of Marana for approval of a preliminary plat for 118 single family detached
manufactured home lots on 29.78 acres which includes lots 1 -118 and common areas "A"
through "D"; and
WHEREAS, the preliminary plat was presented to the Marana Planning Commission on
February 28, 2001, and the Planning Commission recommended 5-0 that the Town Council
approve the preliminary plat; and
WHEREAS, the Marana Town Council has heard from the representative(s) of the owner,
staff, and members of the public at the regular Town Council meeting held June 19, 2001, and has
determined that the Twin Peaks Highlands Preliminary Plat submitted by The Myers Development
Corporation should be approved with conditions.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of
Marana, Arizona authorizing that the l~reliminary Plat for 102 single family detached
manufactured home lots on 29.78 acres of property located within a portion of the Southwest ¼
of Section 20, Township 12 South, Range 12 East be approved upon the following conditions:
1. That lots 22 through 37 be stricken from the preliminary plat, as they are in conflict with the
floodplain of Safford Peak Wash, and
2. That intrusions into the natural open space associated with the first phase of the Twin Peaks
Project be revegetated in accordance with the landscape plan prepared by the Safford Peak
Watershed Education Task Force.
3. Homes shall be restricted to single story and this limitation shall be recorded in revised CC &
R's for the project.
4. A decorative perimeter block wall shall be constructed along the entire frontage of the project
facing Silverbell Road. (The size and detail of the wall shall be approved by the Development
Services Administrator.)
5. The thirty-foot (30') Common Area "D" between Silverbell Road and the perimeter wall shall
be landscaped; the scope and detail of which shall be approved by the Development Services
Administrator and the Planning Department.
6. Front yard landscaping shall be included with all homes. Minimum landscaping shall include,
but not be limited to, one (1) fifteen gallon tree, three (3) five-gallon shrubs, three (3) one-
gallon ground covers, 1/2" decorative rock over the entire front yard, and river rock within the
drainage swales between homes.
7. The Retention Basin at the northwest comer of the property shall contain playground
equipment or other structures to accommodate recreational usage by residents of the
community as prescribed by Marana Parks and Recreation Department.
8. The 75' wide Drainage Channel at the west boundary of the project shall remain in a natural
state, except for the proposed encroachment for Misty Brook Drive, as identified on the
Preliminary Plat. All disturbed areas created by construction activity and improvements
associated with this project and Twin Peaks Subdivision, required for bank protection shall be
re-vegetated with plant densities and types that meet the criteria for plants in this area.
9. The 50' wide Drainage Cb~amel at the south boundar3, of the project shall remain open space,
be improved with bank protection, and landscaped for mitigation in accordance with the
Biological Assessment and approvals from the U.S. Fish and Wildlife Service, Environmental
Protection Agency and the State of Arizona Game and Fish Department.
10. Trail connectivity shall be provided to, and approved by Parks and Recreation Department.
11. All homes shall be painted with muted earth-tone colors, approved fi.om color samples by the
Development Services Administrator.
12. One (1) attached or detached two-car garage, as approved by the Development Services
Administrator, shall be provided for each home.
13. All manufactured homes in this subdivision shall be "ground set" on a permanent foundation~
14. The minimum lot square footage shall be 4,500 square feet.
15. All homes shall be sold with the land they are on, and none may be leased.
16. On the Final Plat show the upstream/downstream sizing of the large drainage channel on
the west side of the project.
17. Where possible, all exterior light fixtures in Twin Peaks Estates facing shall Scenic Drive
shall be shielded.
18. Signage shall be placed at 100 foot intervals along the perimeter of the Natural
Undisturbed Open Space separating Twin Peaks Estates and Scenic Drive which identifies
the area as a natural buffer area.
19. If possible, the structure on lot 16 of Twin Peaks Estates shall be repainted to an earthtone
color.
