HomeMy WebLinkAboutResolution 2001-044 designating the town engineer with jurisdiction over placement of regulatory signs MARANA RESOLUTION NO. 2001-44 RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA TO DESIGNATE THE TOWN ENGINEER AS THE OFFICIAL WITH JURISDICTION OVER PLACEMENT OF REGULATORY SIGNS. WHEREAS, Council currently has jurisdiction over the placement of regulatory signs; and WHEREAS, Arizona Revised Statute § 28-643 allows local anthodties to place and maintain traffic control devices as they deem necessary to regulate, warn or guide traffic; and WHEREAS, Arizona Revised Statute § 28-641 requires that a manual of uniform traffic control devices be adopted by the government body with jurisdiction over traffic control; and WHEREAS, the Town of Marana has adopted the Manual on Uniform Traffic Control Devices (MUTCD); and WHEREAS, the MUTCD section iA-3.1 gives authority for placement of traffic control devices to the public body or designated official having jurisdiction. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Marana, Arizona, to transfer authority for the installation and maintenance of traffic control devices within the Town to the Town Engineer. ATTEST: TON, JR. ~own C, er k APPROVED AS TO FORM: As Town Attorney and not personally EXHIBIT "A" EXAMPLE MARANA TOWN OF MARANA SPEED REGULATION ' The Town Engineer of the Town of Marana, having been given authority for the placement and maintenance of traffic control devices within Town limits per Town Resolution #2001-44, iS empowered by Arizona Revised Statute (A.R.S.) {}28-703 to determine and declare a safe and reasonable maximum speed limit on the basis of an engineering and traffic investigation. Pursuant to this authority, the Town Engineer of the Town of Marana, determines and declares the following maximum speed to be reasonable and safe on the section of roadways within Town limits as designated below: On: Street name For a distance of: length in miles Beginning: milepost or intersection Ending: milepost or intersection The maximum speed set forth above shalI be effective at all times, but does not supercede the directive of A.R.S. {} 28-701.A, requiting that a driver shall exercise prudence in determining a safe driving speed given the circumstances, conditions and actual and potential hazards then existing. The maximum speed established by this regulation shall be effective as of the date of installation of R2- 1 speed limit sign(s). This regulation rescinds and revokes any and all previous regulations fi.xing the maximum speed limit on the above section of roadway. Pursuant to this authority, the'Town Engineer of the Town of Marana, determines and declares that tyre of action shall be prohibited within the right-of-way of the following areas herein set forth: On: Street name For a distance of: length in miles Beginning: milepost or intersection Endin. g: milepost or intersection The parking regulation set forth above shall be effective at all times, and no person shall stop, stand or park a vehicle in violation of the restrictions stated on the sign(s). Prohibition of parking in the areas established by this regulation shall be effective as of the date of installation of the R 7 or R8 regulatory sign(s).. This regulation rescinds and revokes any and all previous regulations regarding the parking, standing, or stopping of vehictes along the section of roadway established herein.
