A RESOLUTION OF THE MAYOR AND TOWN cOUNCIL OF THE ToWN OF MARANA,
FOR INGRESS/EGRESS
ARIZONA, APPROVING THE REQUIREMENT OF PAVING OF ROADWAYS THAT ARE
EASEMENTS SERVING NEW DEVELOPMENTS AND PAVING
ADJACENT TO NEW DEVELOPMENT.
WHEREAS, the dust problems associated with unpaved roadways are unacceptable for
outcome for new projects proposed within the Town of Marana, and are undesirable for the objective
of optimum air quality; and
WHEREAS, the paving of such roadways will result in reduced maintenance costs for the
Town of Marana, said maintenance costs being the responsibility of the owners of the land being
served by the ingress/egress easements; and
WHEREAS, requiring the developers of properties to pave the roadways serving and/or
adjacent to their proposed projects is in keeping with our intent to require new development to pay for
itself, thus avoiding "free ridership"; and
WHEREAS, requiring the developers of properties to pave said roadways will encourage the

WHEREAS, the future use of these sites by residents of and visitors to the Town of Marana
will be enhanced by consistent roadway surfaces; and
WHEREAS, the Town Council has determined that it is in the best interests of the Town and
its citizens that unpaved roads are not an acceptable reflection of the future of the Town;
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Marana,
Arizona, that the following requirement is adopted as policy: "All ingress/egress easements which
are required for the subject property or unpaved public roads abutting the property shall be paved
with a durable asphalt, concrete, stone, tile, or brick surface consistent with pavement deS~T~egndeveloper
principles and engineered according to the soil conditions and wheel loads anticipated.
shall further covenant to maintain any ingress/egress easements serving or abutting the property in
good repair to prevent dust pollution."
PASSED AND ADOPTED by the Mayor and Council of the Town of Marana, Arizona, this
