HomeMy WebLinkAboutResolution 2001-080 formation of overlay for commercial district within continental ranchMARANA RESOLUTION NO. 2001-80 A RESOLUTION OF THE MAYOR AND TOWN COUNCIL OF THE TOWN OF MARANA, ARIZONA, CALLING FOR A STUDY AND THE FORMATION OF AN ZONING OVERLAY DISTRICT FOR THE COMMERCIAL DISTRICT WITHIN CONTINENTAL RANCH, IN THE AREA ALONG SILVERBELL ROAD BETWEEN DRAINAGEWAY NO. 10 AND TWIN PEAKS BOULEVARD. WHEREAS, the Town of Marana welcomes and encourages planned growth and organized development within its corporate limits, in order to preserve the Town's quality of life and vibrant economy; and WHEREAS, the Town has historically placed heavy emphasis on good planning practices and has guided commercial development according to those practices, to sustain the Town's economic prosperity without irreparably damaging its natural resources or diminishing the quality of life of its residents; and WHEREAS, the Mayor and Council ofthe Town of Marana have determined that the Town and its residents have a significant interest in encouraging planned growth and organized development, according to good planning practices; and WHEREAS, the Mayor and Council find that the pace of commercial development in the area along Silverbell Road between Drainageway Number 10 and Twin Peaks Boulevard threatens to exceed the ability of public services and facilities necessary to sustain it; and WHEREAS, the Mayor and Council find that the pace of commercial development in the aforementioned area places a heavy strain on the infrastructure oftbe Town, and there currently exists a compelling need to study commemial growth in this area in order to assure sufficient public services and facilities to support expanded commercial development in said area; and WHEREAS, controlled and planned growth in this area is necessary in order to assure a wide diversity of uses, to minimize future noise and light pollution, to avoid increased volume and density of traffic, and to prevent a proliferation of incompatible uses; and WHEREAS, the Mayor and Council find that application of existing development ordinances does not adequately address the specific concerns of the aforementioned area, and in order to achieve these goals further study is necessary in order to plan an overlay zoning district to address these and other issues; and Page 1 of 3 WHEREAS, the Mayor and Council find that in order to allow time to study and implement an overlay zoning district, aH development in the aforementioned area must be immediately suspended for a period of six months. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Marana, Arizona, as follows: Section 1: The Town's staff is hereby directed to examine the commercial corridors system in Continental Ranch along Silverbell Road, fi:om Drainageway Number 10 to Twin Peaks Boulevard, and develop regulations and an overlay zoning district, in order to minimize the strain on public infi:astructure and maximize the public benefit, and be prepared to present the findings to the Town Council within six months of the effective date of this Resolution. Section2: The Town Manager is hereby granted authority to form an advisory committee, made up residents, neighborhoods, business interests and town staff, in order to study the development needs of the area and make recommendations to the Planning Department. Section 3: The processing ofall commercial development within the aforementioned area is hereby suspended for a period of six months, beginning on the effective date of this Resolution. Section 4: All ordinances, resolutions, or motions and parts of ordinances, resolutions, or motions of the Council in conflict with the provisions of this Resolution are hereby repealed, effective as of the effective date of this Resolution. Section 5: If any section, subsection, sentence, clause, phrase or portion of this Resolution is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions hereof. ~dayPASS[D AND ADOPTED by the Mayor and Council of the Town of Maran~ Arizona, this of Ju~2001.
