A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA,
AUTHORIZING AN INTERGOVERNMENTAL AGREEMENT WITH THE ARIZONA
DEPARTMENT OF PUBLIC SAFETY FOR THE DISBURSEMENT OF FUNDS FROM THE
CRIMINAL JUSTICE ENHANCEMENT FUND.
WHEREAS, the Town of Marana recognizes its duty to protect its citizens through effective
law enforcement; and
WHEREAS, the Criminal Justice Enhancement Fund Advisory Committee has awarded
$4,000 to the Marana Police Depat:hnent for the prevention of residential and commercial burglaries;
and
WHEREAS, the Marana Police Department has agreed to the conditions of the agreement;
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of
Marana, Arizona as follows:
Section 1. That approval of the agreemem between the Town and the Arizona Department
of Public Safety to disperse Criminal Justice Enhancement Funds is granted.
Section 2. That David R. Smith, Chief of Police, is appointed agent for the Town of Marana,
to conduct all negotiations, execute and submit all doeumems and any other necessary or desirable
instruments in connection with such grant.
PASSED AND ADOPTED by the Mayor and Council of the Town of Marana, Arizona, this

This agreement is made under the authority ofA. R. S. 41-2401 et seq. and Arizona Administrative
Rules R10-4 Article 3.
This agreement must be approved by the Marana CiOL/lown Counc and a copy of that approval
must be provided to the Arizona Department of Public Safety.

STATUTORY PURPOSE(S):
[X] Prevent residential/commercial burglaries
Control street crime
Locate missing children
PROJECT TITLE AND DESCRIPTION:
"Burglary Awareness & Reduction Project"
The agency shall implement a public education program by acquiring equipment and educational
materials concerning burglary prevention techniques.
The Department of Public Safety agrees to pay the grantee the above shown sum from the Criminal
Justice Enhancement Fund (CJEF) subject to the conditions provided herein,
GENERAL CONDITIONS:
1. That the Criminal Justice Enhancement Fund (CJEF) monies will not be used to supplant state or
local ftmds;
2. To expend the CJEF monies only for the purpose(s) stated above and in the budget
categories and for the specific items shown in the attached budget;

3. To reimburse the Arizona Department of Public Safety for any unauthorized or ineligible
expenditures;
4. To provide proper accounting and monitoring procedures to ensure fiscal control and efficient
management of the funds;
5. To return to DPS all interest earned, recovered currency (by court action), or case expense
reimbursement directly relating to the CJEF grant;
6. To provide detailed quarterly financial and project reports to the Arizona Department of Public
Safety in the manner prescribed by the Arizona Department of Public Safety within 30 days after
the end of the quarter and/or project;
7. To provide a detailed and complete final project report within sixty days ofthe project end date in
the manner proscribed by the Arizona Department of Public Safety;
8. That this agreement is subject to cancellation by the Governor for conflicts of interest pursuant to
A.R.S. 38-511;
9. To abide by the non-discrimination requirements of Executive Order 75-5 (enclosed);
10. That the grantee is acting as an independent contractor and will indemnify and hold the Arizona
Department of Public Safety harmless for the actions of the grantee's employees;
11. To use arbitration, after exhausting administrative reviews, to resolve disputes arising out ofthis
agreement where the sole relief sought is monetary damages of 10,000 dollars or less;
12. That there are no promises or requirements other than those expressly stated in writing and
signed by both parties hereto;
13. That requests for changes to this agreement shall be in writing and amendments to this agreement
shall be in writing;
14. That this agreement is subject to termination by the Arizona Department of Public Safety for a
lack of funds or reasonable grounds to believe the grantee has violated the terms of this
agreement. Such notice of termination shall be in writing. The grantee agrees to return all
remaining grant funds within thirty days of such notice of termination;
15. That this agreement may be canceled by the grantee upon written notice to the Arizona
Department of Public Safety and any unexpended CJEF fimds shall be returned to the Arizona
Department of Public Safety;
16. To retain all grant records and supporting documentation for a period of five years after project
completion and make all records available for inspection and audit by the State upon request.
17. That all overtime fimded by CJEF will be paid out at a rate not to exceed 1.5 times the normal
rate of pay.
18. Property and/or cash forfeited under the R.I. C.O. statutes is not considered project revenue and
should not be reverted to the Arizona Department of Public Safety.
