HomeMy WebLinkAboutResolution 2001-100 establishing the marana public works arts project committeeMARANA RESOLUTION NO. 2001-100 A RESOLUTION OF THE MAYOR ANT) COUNCIL OF THE TOWN OF MARANA, ARIZONA, ESTABLISHING THE MARANA PUBLIC WORKS ARTS PROJECT COMMITTEE WHEREAS, The Town of Marana is about to embark on Capital Improvement Projects which are of greater scope and magnitude than any projects previously undertaken by the Town; and, WHEREAS, Public works of art are prominent in all of the great cities of the United States and abroad; and WHEREAS, the Town accepts the responsibility for expanding the opportunities for its citizens to experience art in public places; and, WHEREAS, The Town also recognizes economic benefits gained through the enhancement of tourism. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Marana, Arizona, as follows: Section 1-100. Established; function; membership. There is hereby established Marana Public Works Arts Project Committee (Committee) to act in an advisory capacity to the Marana Town Government (Town) in connection with public works arts projects within the Town. Such Committee shall consist of members appointed by the mayor, subject to confirmation by a majority of the town council representing the following categories: 2. 3. 4. 5. Architecture Marana Arts Council (MAC) Visual arts Chamber of Commerce Business Advisory Committee The initial five (5) members of said Committee shall be appointed as of the first day of October, 2001. For the initial appointments, the first three members, listed alphabetically, shall be appointed for a full three-year term. The remaining two (2) members shall be appointed for a two-year temp. Upon the expiration of each of the aforesaid terms of office, the succeeding term of office for each of the five (5) members shall thereafter be for a period of three years. Section 1-101. Compensation of member. Members shall serve without compensation from the Town for their service as such members; but this limitation shall not preclude a member or his firm from receiving compensation from the Town under contract or otherwise for services rendered outside his duties as member of the Committee. Section 1-102. Organization; consultation with town officers, departments and committee. The Committee shall organize and elect a chairman annually and adopt such administrative procedures as are necessary to accomplish the purposes mentioned in Section 1-100. The Town Public Works Director shall serve as an ex officio member of this board providing consultation and advise to the Committee. Other Town staff member may from time to time consult and advise the Committee on matters coming within the scope of this division; and the Committee may likewise consult and advise with such officers. Section 1-104. Municipal public art program. (a) Purpose. The Town accepts responsibility for expanding the opportunities for its citizens to experience art in public places. The Town also recognizes the economic benefits to be gained through the enhancement of tourism. A policy is therefore established to direct the inclusion of works of art in certain Town construction projects or other town owned properties and to encourage the inclusion of works of art in private developments in the Town of Marana. (b) Definitions. For the purposes of this section: Town construction project means any capital project paid for wholly or in part by funds appropriated by the Town Council for new construction of a building, parking facility, park, arterial street, or sidewalk. Construction cost means the total Town-funded portion of a Town construction project less demolition costs, equipment costs, and real property acquisition costs. Demolition costs means payments for any work needed for the removal of buildings or other existing structures from Town property. (c) Equipment costs means payments for any equipment or furnishings that are portable and of standard manufacture. Equipment shall not mean items that are custom designed for, or that create a new use for, a facility, whether portable or affixed. Real property acquisition costs means payments made for the purchase of parcels of land, existing buildings or structures, and costs incurred by the Town for appraisals or negotiations in connection with such purchase. Works of art or artwork shall mean any form of original, permanent creation of visual art, which shall include, but not be limited to: (1) Paintings of all media such as frescoes and murals; (2) Sculptures, in any material or combination of materials, for ornamentation or commemoration such as statues, monuments, fountains, arches, bas-reliefs, mobiles, or kinetic, electronic, and neon sculptures; and (3) Other forms such as inscriptions, stained glass, fiber works, carvings, mosaics, photography, drawings, collages, textile works, prints, or decorative or utilitarian crafts utilizing clay, fiber, wood, metal, glass, stone, plastic, and other materials. Funds for works of art. (1) Allocations. All allocations for funds for eligible Town construction projects shall include an mount of up to one (1) percent of the construction_cost to be used for the selection, acquisition and commissioning of works of art. If the source of funding, applicable law governing any particular project, or the expenditure of such funds precludes art as a permissible expenditure, then the amount shall be excluded as required. Town construction projects with a construction cost of less than five hundred thousand dollars ($500,000) shall be excepted, and no allocation shall be made on such projects. Eligible Town construction projects for operational facilities that are not visited by the public on a routine basis nor designed for public access shall not have publicly funded interior artwork, but the exterior of such facilities remain eligible for artwork. Separate accounting shall be established for each Town project. (2) Grant applications. From the effective date of this section, applications for capital projects to granting authorities shall include amounts for works of art as specified herein, insofar as permissible by the granting authority. (d) (3) Uses of funds. Funds allocated in accordance with this section may be used for the selection, acquisition, purchase, commissioning, placement, and installation of works of art. The works of art shall be permanent, may be integral to the architecture, or may be placed in, on, or about a Town construction project or other Town property. To the extent practical, artist selection should be concurrent with selection of the architect or designer to ensure integration of the artwork into the project architecture. Specific parameters for artwork may be established for Town construction projects as is deemed appropriate by the Town Public Works Director. In the event that a particular Town construction project is deemed inappropriate for the placement of artwork, artwork shall be used at other more appropriate public sites as determined by the Director of Development Services. Professional Assistance to Committee. Additional art professionals may be consulted with or temporarily appointed to the Committee when deemed appropriate by the Town Public Works Director to participate in the artwork selection process to ensure artwork that is compatible with public infrastructure standards for durability, safety, and liability. Section 1-105. Advising as to beautification of private property and as to construction of private buildings. The Committee may advise with owners of private property in relation to the beautification of such property; and anyone contemplating the erection of any building or making any improvement thereon may submit the plans and designs or sketches thereof to the Committee for advice and suggestion for which no charge shall be made by the Committee. Section 1-106. All ordinances, resolutions, or motions and parts of ordinances, resolutions, or motions of the Council in conflict with the provisions of this Resolutions are hereby repealed, effective as of the effective date of this Resolution. Section 1-107. If any section, subsection, sentence, clause, phrase or portion of this Resolution is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions hereof.
