HomeMy WebLinkAboutResolution 2001-111 approving policy for appointments to the planning and zoning commission MARANA RESOLUTION NO. 2001-111 A RESOLUTION OF THE MAYOR AND TOWN COUNCIL OF THE TOWN OF MARANA, ARIZONA, ADOPTING A POLICY FOR THE SELECTION OF CANDIDATES TO FILL VACANCIES TO THE MARANA PLANNING AND ZONING COMMISSION. WHEREAS, the Town of Marana has established the Marana Planning and Zoning Commission, consisting of seven members who are appointed to staggered terms by the Mayor and Council; and WHEREAS, vacancies occur on the Planning and Zoning Commission by reason of expired terms as well as other reasons, and the Mayor and Council have determined that a standardized policy on filling such vacancies is needed in order to make the best selection and optimize the talent and human capital in the Town's population; and WHEREAS, the Mayor and Council find that adoption of the Policy for Appointments to the Marana Planning and Zoning Commission, attached hereto as Exhibit "A," is in the best interests of the residents of the Town of Marana, Arizona. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Marana, Arizona, as follows: Section 1: The policy for Appointmentsto the MaranaPlanning andZoning Commission, attached hereto as Exhibit "A" is hereby adopted. Section 2: All ordinances, resolutions, or motions and parts of ordinances, resolutions, or motions of the Council in conllict with the provisions of this Resolution are hereby repealed, effective as of the effective date of this Resolution. Section 3: If any section, subsection, sentence, clause, phrase or portion of this Resolution is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions hereof. Page 1 of 2 ATTEST: ~PROVED AS TO FO~: ~D~el J~Hochu~ ~ Tom Attorney ~d not permm~y Page 2 of 2 Policy for Appointments to the Marana Planning and Zoning Commission The following policy guidelines have been established by the Mayor and Council in order to establish general guidelines to be followed in filling vacancies to the Marana Planning and Zoning Commission. When a vacancy eyasts for any reason, the following events shall occur, however the failure to follow each step in the Guidelines shall not act to void an appointment that is otherwise legal. 1. The Town Clerk shall notify the Mayor and Town Council Members in writing of the vacancy, including the name of the departing Member, the date of the vacancy, and the date the term will end for the vacant seat. 2. The Mayor and each Council Member may nominate one (1) person to fill the vacancy. If a nomination is made, ~t must be subautted to the Town Clerk m writing, and must be received by the Town Clerk within fourteen (14) days of the date of the Clerk's Notice of Vacancy. 3. The Town Clerk shall thereafter arrange for interviews of all nominated candidates by the Mayor and Town Council. The interviews will be conducted at an Executive Session at a regular council meeting or special council meeting. A candidate will not be automatically disqualified for the sole reason that he or she is unable to attend the scheduled interview. The Mayor and Council will not vote or take action on the appointment at the same meeting as the interviews. a Special Council Meeting called 4. At the next Council Meeting following the interviews, or at vacancy by following the interviews, the Mayor and Town Council shall discuss and fill the vote and Resolution. 5. Any time the Town Clerk receives a letter of inquiry or application for appointment to the Planning and Zoning Commission, he or she shall forward such letter or application to the Mayor and each Town Council Member, and shall keep the origiml in the Town files. The Town Clerk shall advise the applicant by letter, with a copy of this Policy, of the procedure to be followed. 6. If more than one vacancy exists at the same time, this procedure shall be followed for each vacancy, and the Mayor and each Town Council Member maY nominate a person for each such vacancy.
