A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA,
ARIZONA, APPROVING THE DEVELOPMENT PLAN, SUBMITTED BY ARIZONA
PAVILLIONS LCC, FOR THE DEVELOPMENT OF A METRO-FITNESS GYM ON 3.48
ACRES WITHIN THE CONTINENTAL RANCH SPECIFIC PLAN LOCATED ON A
PORTION OF PARCEL 63A AND MORE SPECIFICALLY NORTHWEST OF THE
CORNER OF CORTARO ROAD AND ARIZONA PAVILIONS ROAD IN A PORTION OF
THE SOUTHWEST ¼ OF SECTION 26, TOWNSHIP 12 SOUTH, RANGE 12 EAST.
WHEREAS, the Town of Marana approved and adopted the Specific Plan for the area
known as Continental Ranch on April 5, 1988 (Ordinance 88.09), located within the corporate
boundaries of the Town of Marana, Arizona; and
WHEREAS, Arizona Pavillions LLC is the owner of property located northwest of the
comer of Cortaro Road and Arizona Pavilions Road more particularly within a portion of the
southwest ¼ of Section 26, Township 12 South, Range 12 East known as a portion of Parcel 63A
of the Continental Ranch Specific Plan and has applied to the Town of Marana for approval of a
Development Plan for a Metro-Fitness gym on 3.48 acres described in Exhibit A, attached
hereto and incorporated heroin by this reference as (Exhibit "A'); and
WHEREAS, the preliminary plat was presented to the Marana Planning Commission on
August 29, 2001, and the Planning Commission recommended 5-0 that the Town Council
approve the preliminary plat; and
WHEREAS, the Marana Town Council has heard bom the representative(s) of the owner,
staff, and members of the public at the regular Town Council meeting held September 18, 2001,
and has determined that the Development Plan for Metro-Fitness in Continental Ranch on a
portion of Parcel 63A should be approved.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of
Marana, Arizona, that Metro-Fitness, submitted by Arizona Pavillions LLC for a Metro-Fitness
gym on 3.48 acres of property known as a portion of Continental Ranch Parcel 63A located
within the Continental Ranch Specific Plan area more specifically northwest of the comer of
Cortaro Road and Arizona Pavilions Road in a portion of the southwest ¼ of Section 26,
Township 12 South, Ranch 12 East, is hereby approved.
PASSED AND ADOPTED by the Mayor and Council of the Town of Marana, Arizona,
this 1 gth day of September, 2001.

That portion of Section 26, Township 12 South, Range 12 East, Gila and Salt River Base and
Meridian, Pima County, Arizona, described as follows:
COMMENCING at the Northwest corner of the Southwest one-quarter (SW 1/4) of said Section
26, said point also being on the Southwesterly line of Peppertree Ranch Business Park as recorded
in Book 33 of Maps and Plats at Page 97, Pima County Recorder's Office;
THENCE South 46 degrees 04 minutes 51 seconds East, along said Southwesterly line, a distance
of 1,045.44 feet to the Point of Beginning;
TH3e~NCE South 46 degrees 04 minutes 51 seconds East, along said Southwesterly line, a distance
of 650.73 feet to a point on the arc of a non-tangent curve, concave to the Southeast, a radial line
of said curve through said point having a bearing of North 55 degrees 50 minutes 13 seconds
West, said point being on the Northwesterly right-of-way line of the realigned Cortaro Road;
TFIENCE Southwesterly, along said right-of-way line, along the arc of said curve, to the left,
having a radius of 3,894.72 feet and a central angle of 00 degrees 39 minutes 40 seconds for an arc
distance of 44.94 feet to a point to tangency;
TWENCE South 33 degrees 30 minutes 07 seconds West, along said right-of-way line, a distance of
894.02 feet to the East line of that Parcel of land recorded in Docket 6165, Page 1453;
THENCE along the West line of said Parcel, the following courses and distances;
North 13 degrees 17 minutes 17 seconds West, 577.91 feet;
North 03 degrees 31 minutes 23 seconds East, 670.37 feet;
South 46 degrees 04 minutes 51 seconds East, 100.00 feet;
North 43 degrees 55 minutes 09 seconds East, 100.00 feet to the Point of Beginning.
