A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA,
ARIZONA, APPROVING THE PRELIMINARY PLAT FOR COUNTRYSIDE RIDGE,
SUBMITTED BY U.S. HOMES, FOR A 93-LOT SINGLE FAMILY DETACHED HOME
SUBDIVISION ON 22.07 ACRES LOCATED ON BLOCKS 5 & 6 OF COUNTRYSIDE
VISTA, IN A PORTION OF SECTION 24, TOWNSHIP 12 SOUTH, RANGE 12 EAST, AT
THE SOUTHEAST CORNER OF LINDA VISTA BOULEVARD AND HARTMAN LANE.

W14EREAS, said property was rezoned by Ordinance No. 99.17 on July 6, 1999, which
was specific as to six conditions, as follows:
1. An on the ground survey for cultural remains prior to any ground modifications
subject to the approval of the Arizona State Museum;
2. The resolution of water service provision prior to the approval of the Final Plat by
Town Council;
3. The dedication of additional right-of-way for Hartman Lane to accommodate a
ha[fright-of-way of 50 feet;
4. No asphalt-shingled roof shall be allowed;
5. No roof mounted mechanical equipment shall be allowed;
6. Lots shall be a minimum of 5,000 square feet; and
WHEREAS, all of said conditions have been satisfied; and
WHEREAS, Section 2 of Ordinance No. 99.17 states that the purpose of the rezoning is
to "allow for the devetopmem of a 105-1ot single family residential subdivision, which includes
approximately 2.3 acres of open space of which at least 41,200 square feet will be developed as a
recreation area"; and
WHEREAS, said property is located in habitat suitable for the Cactus Ferruginous Pygmy
Owl; and
WHEREAS, the previous owner of said property consulted with U.S. Fish and Wildlife
and made an agreement to mitigate this land with other lands, confirmed in a letter fi.om U.S.F.W.
dated July 29, 2000; and
WHEREAS, included in the recommendations of the Biological Assessmem is the set-
aside of 2.4 acres of xeroriparian natural open space next to the wash, which is identified on the
maps as "R- 144", and is also the passive recreational area; and

WHEREAS, the Owner/Developer has provided 4.06 acres of developed active and
passive recreational space within the subdivision, including improved trails, low-voltage lighting,
recreational equipment, and a half basketball court; and
WHEREAS, the Mayor and Council of the Town of Marana have heard from the
representative(s) of the owners, staff, and members of the public at the regular Town Council
meeting on October 16, 2001; and
WHEREAS, the Mayor and Council have determined that approval of the Preliminary Plat
for Countryside Ridge is in the best interest of the residents of the Town.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of
Marana, Arizona, that the Preliminary Plat, submitted by U.S. Homes, for a 93-1ot single family
detached home subdivision on 22.07 acres located on Blocks 5 & 6 of Countryside Vista, in a
portion of Section 24, Township 12 South, Range 12 East, at the southeast comer of Linda Vista
Boulevard and Hartman Lane, is hereby approved with the following conditions:
1. Any undisturbed open areas must be fenced during constmction~ The Town and
the developer have agreed that view fencing will be installed at the rear of lots 1 -
10 to protect the Undisturbed Natural Open Space.
2. Add a plat note stating that the Homeowners Association will be responsible for
the integrity and maintenance of all Undisturbed Natural Open Space. The
developer will provide the appropriate easement to the Homeowners Association.
3. No ground disturbance, including plant salvage or grading, shall be allowed prior
to receipt of confirmation from U.S. Fish and Wildlife that the off-site mitigation
of this site is complete.
4. All ESA-reiated conditions (attached as Addendum A) must be included in the
storm water pollution prevention plan for the project.
5. Applicant shall pay the Town $100,000 for additional off-site parks and recreation
improvements.

PASSED AND ADOPTED by the Mayor and Council of the Town of Marana, Arizona,
