HomeMy WebLinkAboutResolution 2001-154 supplemental pay policy MARANA RESOLUTION NO. 2001-154 A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA, ESTABLISHING A SUPPLEMENTAL PAY POLICY FOR EMPLOYEES WHO ARE CALLED TO ACTIVE DUTY DUE TO OPERATION ENDURING FREEDOM. WHEREAS; the Town of Marana has established a military leave policy, as found in Personnel Policy 4-5, in accordance with state and federal law; and WHEREAS; state law does not require an employer to pay an employee on military leave ia excess of the mandated 30 days of paid military leave during a two-year period; and WHEREAS, state and federal law do not provide for the hardship incurred by an employee and the employee's family if the employee is compensated at a rate less than the employee's Town compensation; and WHEREAS, the Mayor and Council of the Town of Mm Arizona, wish to supplement an employee's military compensation so that the employee and the employee's family do not incur a financial hardship caused by reduced income while on active duty; and WHEREAS, Arizona's law, as found in Arizona Revised Statutes, Title 26-168, requires the Town to allow employees who are members of any branch, reserve or auxiliary of the armed forces, 30 days of paid military leave during a two-year period to attend any military mining; and WHEREAS, federal law requires an employee to continue coverage of health benefits for up to 18 months at 102% of the applicable premium: an amount that may be burdensome to those who are called to military service; and WHEREAS, the current call-up for active duty has been designated for a minimum of 45 days up to two years. I~OW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Marana, Arizona, as follows: 1. The Town shall supplement the deficit, if any, between regular pay from the Town and any compensation received from the military during the call-up for Operation Enduring Freedom; 2. Employees called up for active duty must use their federally required 30-day paid leave before supplemental pay begins; Ivtarana Reaolution N o- 2001-154 Page I of 2 3. If the employee's military compensation equals or exceeds the employee's Town compensation, there shall not be any supplemental pay; 4. This supplemental pay policy sunsets at the end of Operation Enduring Freedom or at the end of 24 months, whichever comes first, and 5. Town employees called to active duty for more than 30 days shall be allowed to continue their medical and dental benefits at the rate of their normal payroll deduction amou. nt for up to 1 $ months. ARer that, employees shall be allowed to continue their group insurance benef~ by paying 100% of the applicable premium for as long as they are employed. Group insurance benefits continuation shall be available even if there is no supplemental pay.
