RESOLUTION NO. 2000-02, originally recorded on January 7, 2000, in
Docket 11209, pages 1479 & 1480, is being re-recorded to correct an
omission of necessary exhibits called out within the text of this
resolution. There are no changes being made to the original text of the
resolution. The additional pages, labeled Exhibit I and Exhibit A,
include the location map and legal description of the area authorized
for abandonment by the Marana Town Council per Resolution No.
2000-02, passed and adopted on January 4, 2000.

MARANA RESOLUTION NO. 2000-02.
A RESOLUTION OF THE MAYOR AND TOWN COUNCIL OF THE TOWN OF MARANA,
ARIZONA, ABANDONING THE TOWN OF MARANA'S INTEREST IN SIX (6) EASEMENTS
LOCATED IN THE pEPPERTREE RANCH BUSINESS PARK PLAT AS RECORDED WITH
PIMA COUNTY RECORDERS OFFICE 1N BOOK 33, PAGE 97 OF MAPS AND PLATS.
WHEREAS, an application for abandonment of the Town's interest in six (6) easements
located'in the Peppertree Ranch Business Park Plat as recorded in Book 33, Page 97 has been
submitted to the Town by The WLB Group representing Southwest Value Parmers; and
WHEREAS, the Mayor and Council have the authority pursuant to A.R.S. ~. 28-7214 does
not own title to a roadway but holds right-of-way easements, the easements may be extinguished by
the governing body's resolution; and
WHEREAS, it has been determined by the Mayor and Council that the six (6) easements
located in the peppertree Ranch Business Park Plat as recorded in Book 33, Page 97 are no longer
necessary to the town, notice of the intended abandonment has been posted on the property and
published in the appropriate manner; and.
WHEREAS, the Mayor and Council has determined that the land is of no monetary value
due to its location and degree of fragmentation.
: NOW, THEREFORE, BE IT RESOLVED by the Mayo.r and ,C.oun. ci~of the~ To~wn ~hf
Marana, Arizona, that the Town of Marana abandon (6) easements locaten m the veppertree ~.anc
Business Park Plat as recorded in Book 33, Page 97, as more fully depicted in the map attached
hereto as Exhibit 1 and legally described in Exhibit A and incorporated herein by this reference, that
are no longer necessary to the Town, subject to the following conditions:
1. The following are resolved in accordance with A.R.S..*. 28-7210:
a)

existing sewer, gas, water or similar pipelines and appurtenances;
canals, laterals or ditches; and appurtenances;
electric, telephone and similar lines and appurtenances.
The abandonment will not prevent any property owner from legally accessing their property.
