MARANA RESOLUTION NO. 2000-05
A RESOLUTION OF THE MAYOR AND TOWN COUNCIL OF THE TOWN OF MARANA,
ARIZONA, ABANDONING THE 20-FOOT ROADWAY AND UTILITY EASEMENT IN THE
VISTA DE LAS MONTAI~AS SUBDIVISION PLAT AS RECORDED IN BOOK 8 AT PAGE
72, PIMA COUNTY RECORDER'S OFFICE.
WHEREAS, an application for abandonment of the Town's 20-foot roadway and utility
easement in the Vista De Las Montafias Subdivision Plat as recorded in Book 8 at Page 72 has
been submitted to the Town by Ritchie Realty on behalf of Coral Investments, Inc.; and
WHEREAS, the Mayor and Council have the authority pursuant to A.R.S. § 28-7214, to
abando fight-of-way easements, by the governing body's resolution; and
WHEREAS, it has been determined by the Mayor and Council that those portions of the 20-
foot roadway and utility easement as it traverses lots 13 through 17 of the Vista De Las Montafias
Subdivision Plat as recorded in Book 8 at Page 72 are no longer necessary to the Town, and notice
of the intended abandonment has been posted on the property and published in the appropriate
manner; and
WHEREAS, the Mayor and Council have determined that the land is of no monetary value
due to its location and degree of fi'agrnentation.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of
Marana, Arizona, that the Town of Marana abandon that portion of the 20-foot roadway and utility
easement as it traverses lots 13 through 17 of the Vista De Las Montafias Subdivision Plat as
recorded in Book 8 at Page 72, as more fully depicted in the map attached hereto as Exhibit 1 and
legally described in Exhibit A and incorporated herein by this reference, that is no longer necessary
to the Town, subject to the following conditions:

The following are reserved in accordance with A.R.S. § 28-7210:
a) existing sewer, gas, water or similar pipelines and appurtenances;
b) canals, laterals or ditches, and appurtenances; and
c) electric, telephone and similar lines and appurtenances.
The abandonment will not prevent any property owners from legally accessing their property.
