HomeMy WebLinkAboutResolution 2000-010 ina road model home centerMARANA RESOLUTION NO. 2000-10 A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA, AUTHORIZING THE RELEASE OF THE SUBSTITUTE ASSURANCE AGREEMENT BETWEEN BAV PROPERTIES, LLC, AEV PROPERTIES, LLC, SHEI~TZER PROPERTIES, LLC, NJS PROPERTIES, LLC, IRS PROPERTIES, LLC, JASON S. SHENITZER PROPRERTIES, LLC, and WV, LLC, FIRST AMERICAN TITLE COMPANY, A CALIFORNIA CORPORATION, AND THE TOWN.OF MARANA FOR BLOCKS 1-9, AND ACCEPTING FOR MAINTENANCE CERTAIN PUBLIC IMPROVEMENTS IN INA ROAD MODEL HOME CENTER. WHEREAS, Ina Road Model Home Center is a subdivision located west of I-10, north of Ina Road, containing Blocks 1-9, and is recorded at the Pima County Recorder's Office in Book 51 of Maps and Plats, Page 85; and WHEREAS, the Town has previously entered into a Substitute Assurance Agreement with BAV Properties, LLC, AEV Properties, LLC, Shenitzer Properties, LLC, NJS Properties, LLC, IRS Properties, LLC, Jason S. Shenitzer Proprerties, LLC, and WV, LLC, (beneficiaries) under Trust No. 4829 and First American Title Insurance Company, a California Corporation (trustee), recorded in the Pima County Recorder's Office at Docket 11095, Page 1162, assuring the completion of public improvements; and WHEREAS, BAV Properties, LLC, AEV Properties, LLC, Shenitzer Properties, LLC, NJS Properties, LLC, IRS Properties, LLC, Jason S. Shenitzer Proprerties, LLC, and WV, LLC, have fulfilled their obligations under the Substitute Assurance Agreement for Blocks 1-9 and have requested to be released fi.om the Substitute Assurance Agreement; and WHEREAS, the release of assurances for the reasons set forth above and the affirmation of responsibility for maintenance of public improvements is in the best interest of the residents of the Town of Marana. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council ofthe Town of Marana as follows: . BAV Properties, LLC, AEV Properties, LLC, Shenitzer Properties, LLC, NJS Properties, LLC, IRS Properties, LLC, Jason S. Shenitzer Properties, LLC, and WV, LLC, are hereby released from the Substitute Assurance Agreement subject to the following conditions: Marana, Arizona Resolution No. 2000-10 Page 1 of 2 . , Private drainageways, private easements and private sewers will be owned and maintained by each and every block owner within the subdivision. The Town accepts for maintenance a 10 foot public utility easement adjacent to blocks 1-7 and a 15 foot by 15 foot public utility easement adjacent to block 1, block 5 and block 6. Star Commerce Way was accepted for maintenance with Resolution No. 97-79 dated August 5, 1997.
