GEORGE, TITLE GUARANTY AGEN~ OF ARIZONA, INC., AND TOWN OF MARANA FOR LOTS 26-44; ~E OF THE SUBS~ ASSURANCE AGREEMENT BETWEEN KAROL E. GEORGE, TrlIZ GUARANTY AGEN~ OF ARIZONA, INC. AND Tile TOWN OF MAp, AN_ A FOR LOTS 114-181, AND ACCEFrING FOR MAINTENANCE THE PUBLIC IMPROVEMENTS IN VILLAGES AT DOVE MOUNTAIN LOTS 2644 AND Il4-181. WHEREAS, Villages at Dove Mountain ~g Lots 26-44 in a subdivision located east of Dove Mountain Boulevard, south of Moore Road, and recorded at the Pima County Recorder's Office at Book 49 of Maps and Plats, Page 31; and WHE~, Villages at Dove Mountain containing Lots 114-181 in a subdivision located east of Dove Mountain Boulevard, south of Moore ired, and recorded at the Pima County Recorder's Office at Book 51 of Maps and Plats, Page 20; and WHEREAS, the Town has previously entered into a Substitute Assurance Agreement with Karol E. George (beneficiary) under Trust No. T-1293 and Title Guaranty Agency of Arizona, Inc. (trustee), recorded at the Pima County Recorder's Office at Docket 10777, Page 348 assuring the completion of public improvements for lots 26-44; a Substitute Assurance Agreement with Karol E. George Coenefieiary) under Trust No. T-1293 and Title Guaranty Agency of Arizona, Inc. (trustee), recorded at the Pima County Recorder's Office at Docket 10889, Page 631 assuring the completion of public improvements for lots 114-181; and WHEREAS, Karol E. George has fulfilled his obligation under the Substitute Assurance Agreement for Lots 26-44 and has requested to be released from the Substitute Assurance Agreement; and Karol E. George has fulfilled his obligation under the Substitute Assurance Agreement for Lots 114-181 and has reqUested to be released from the Substitute Assurance Agreement; and WHEREAS, the release of assurances for the reasons set forth above and the afrxrmation of responsibility for maintenance of public improvements and streets is in the best interests of the residents of the ToWn of Marana. Marana, Arizona ~n No. 2000-13 Page I of :l NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Marana as follows: Villages at Dove Mountain, Lots 2644 are hereby released from the Substitute Assurance AgreemenL . The Town accepts for maintenance 430 feet of the following paved street and the associated appurtenances: a. Whiptail Court. . Villages at Dove Mountain, Lots 114-181 are hereby released from the Substitute Assurance AgreemenL . The Town accepts for maintenance 1,917 feet of the following paved streets and their associated appurtenances: a. Dove of Peace Drive. Peaceful Dove Place. Owl Head Canyon Road. . The Town accepts for maintenance the regulatory traffic control signs and street signs. PASSED AND ADOPTED by the Mayor and Council of the Town of Mar-ana, Arizona, this day of May, 2000.
