Regular Council meetings are usually held the first and third Tuesday of each month at 7:00 p.m. at the Marana Town Hall, although the date or time may change, or Special Meetings may be called at other times and/or places.. Contact Town Hall or watch for posted agendas for other meetings. This agenda may be revised up to 24 hours prior to the meeting. In such a case a new agenda will be posted in place of this agenda. If you are interested in speaking to the Council during Call to the Public, Public Hearings, or other agenda items, you must fill out a speaker card (located in the lobby outside the Council Chambers) and deliver it to the Town Clerk prior to the convening of the meeting. All persons attending the Council meeting, whether speaking to the Council or not, are expected to observe the Council Rules, as well as the rules of politeness, propriety, decorum and good conduct. Any person interfering with the meeting in any way, or acting rudely or loudly will be removed from the meeting and will not be allowed to return. To better serve the citizens of Marana and others attending our meetings, the Council Chambers are wheelchair -and handicapped accessible. Any person who, by reason of any disability, is in need of special services as a result of their disability, such as assistive listening ,devices, agenda materials printed in Braille or large print, a signer for the hearing impaired, etc., will be accommodated. Executive Session pursuant to A.R.S. § 38-431.03(A)(3),(4) and (7), discussion or consultation for legal advice with the Town's attorneys and discussion and to consider its position and instruct the Town Manager and staff concerning the lawsuit entitled Town of Marana v. Pima County/Pima County v. Marana (consolidated), Maricopa County Superior Court No. CV2008- 001131. 3. ADJOURNMENT Proclamation Silver Star Day 2009 WHEREAS, the Town of Marana honors the sacrifice of the men and women in the Armed Forces; and WHEREAS, the Silver Star Families of America was formed to remind us of the sacrifice those wounded made on our behalf by designing and manufacturing a Silver Star banner and flag; and WHEREAS, the Silver Star Families of America has given freely thousands of Silver Star banners to the wounded and their families; and WHEREAS, the members of the Silver Star Families of America have worked tirelessly to provide the wounded of Arizona and the USA with Silver Star banners, flags and care packages; and WHEREAS, the Silver Star Families of America's sole mission is that every time someone sees a Silver Star banner in a window or flying, that people remember the blood sacrificed for this state and our nation. NOW, THEREFORE, the Mayor and Council of the Town of Marana proclaim as the official day to honor the wounded soldiers of the Marana community May 1, 2009 Loyalty Day and Military Appreciation Month SILVER STAR DAY and extend their appreciation to the Silver Star Families of America and honor their commitment to our wounded Armed Forces members. Bronson, Town Clerk SUBJECT: Resolution No. 2008-110: Relating to Liquor Licenses; approval and recommendation to the State Liquor Board for a new license for a No. 12 (Restaurant) liquor license submitted by Javier Andres Teran on behalf of Nana's Kitchen L.L.C. 8225 N. Courtney Page Way, Ste. 129. DISCUSSION. Javier Andres Teran, on behalf of Nana's Kitchen L.L.C., is applying for a new license for a No. 12 (Restaurant) liquor license for premises located at 8225 N. Courtney Page Way, Ste. 129. The State Department of Liquor Licenses & Control has completed a background investigation and has forwarded two copies of an application for a spirituous liquor license in accordance with the State of Arizona Guide to Arizona Liquor Laws. One copy of the application has been posted on the front of the proposed licensed premises for 20 days prior to this meeting. The Council, as the appropriate governing board, must hold a meeting and either approve, disapprove or offer a "no-recommendation" decision on the application. This action must take place within 60 days of the filing of the application. If the application is approved at the appropriate government level, and no written protests have been received by the Town, and if there is no objection by the Director, the application will be approved. This process normally takes 90 days after the filing of the application. If the governing body disapproves the application or offers a "no-recommendation" decision, or if protests have been filed, the application must be set for a hearing before the State Liquor Board. The hearing may be conducted by the board or by a designated hearing officer. The purpose of a hearing is to consider all evidence and testimony in favor of or opposed to the granting of a license. The applicant for a new license bears the burden of demonstrating his or her "capability, qualifications and reliability" and that the granting of a license. is in "the best interest of the community" except that, in aperson-to-person transfer, an applicant need only prove his or her "capability, qualifications and reliability". An applicant in alocation-to-location transfer need only prove that the granting of the license is in the "best interest of the community". Nana's Kitchen The decision by the board to grant or deny an application will normally take place within 105 days after the application has been filed, unless the director deems it necessary to extend the time period. A.R.S. 4-201, 4-201.01, 4-203; Rule R-4-15-102. ATTACHMENT License application. RECOMMENDATION Staff recommends approval and recommendation to the state liquor board for this liquor license. Silverbell Road. DISCUSSION David Elliott McGuire, on behalf of Monkey Business Eatertainment, is applying for a new license for a No. 12 (Restaurant) liquor license for premises located at 8581 N. Silverbell Road. The State Department of Liquor Licenses & Control has completed a background investigation and has forwarded two copies of an application for a spirituous liquor license in accordance with the State of Arizona Guide to Arizona Liquor Laws. One copy of the application has been posted on the front of the proposed licensed premises for 20 days prior to this meeting. The Council, as the appropriate governing board, must hold a meeting and either approve, disapprove or offer a "no-recommendation" decision on the application. This action must take place within 60 days of the filing of the application. If the application is approved at the appropriate government level, and no written protests have been received by the Town, and if there is no objection by the Director, the. application will be approved. This process normally takes 90 days after the filing of the application. If the governing body disapproves the application or offers a "no-recommendation" decision, or if protests have. been filed, the application must be set for a hearing before the State Liquor Board. The hearing may be conducted by the board or by a designated hearing officer. The purpose of a hearing is to consider all evidence and testimony in favor of or opposed to the granting of a license. The applicant for a new license bears the burden of demonstrating his or her "capability, qualifications and reliability" and that the granting. of a license is in "the best interest. of the community" except that, in aperson-to-person transfer, an applicant need only prove his or her "capability, qualifications and reliability". An applicant in alocation-to-location transfer need only prove that the granting of the license is in the "best interest of the community". Monkey Business Eatertainment The decision by the board to grant or deny an application will normally take place within 105 days after the application has been filed, unless the director deems it necessary to extend the time period. DISCUSSION The Marana Chamber of Commerce was established in 1987 with a vision to "Build Business and Community Relationships." The Chamber's missions for staff and members work collaboratively with all industries and levels of government to build a balance between economic growth and quality of life in our community. The Chamber is requesting $40,000 in discretionary funding to promote economic development in the region. The Marana Chamber is proposing specific activities developed to support the Town in the retention, recruitment, and development of businesses in Marana. 'The activities specified in this plan include: 1. Updating and maintenance of a website that will receive 42,000 hits during the fiscal year. 2. Linking 2,600 visitors annually to community partners providing statistics on economics and tourism. 3. Holding monthly luncheons with 750 members and guests in attendance annually. 4. Holding monthly breakfasts with 780 members and guests in attendance annually. 5. Distributing 7,000 street maps of Marana to area merchants, visitor centers, and attractions. 6. Distributing 10,000 Chamber Directories to area merchants, visitor centers, and attractions 7. Operating the Marana Visitor's Center during established business hours 8:30 am - 4:30 pm Monday -Friday observing regular holidays. The Chamber will monitor and report quarterly on progress in each of these categories. DISCUSSION Conditional Use Permit Request Snap Fitness requests approval of a conditional use permit for the operation of a 24-hour fitness studio within an existing commercial development at 8567 N. Silverbell Road, southeast of Silverbell Road and Continental Reserve Loop. Silverbell Road Commercial Overlay District The project is within a commercial. development located in the Silverbell Road Commercial Overlay District (SRCOD). Development within the SRCOD is regulated by Section 24 of the Land Development Code. The overlay district allows business operations from 5:00 A.M. to 11:00 P.M. Establishments that operate 24 hours a day may be permitted within the SRCOD with approval of a conditional use permit per Section 24.O1.S.3.o of the Land Development Code. History This project was presented to the Planning Commission on July 30, 2008. The Planning Commission is forwarding this conditional use permit to the Town Council with a vote of 6-0 (Commissioner Winger absent) to deny the conditional use permit. The Planning Commission has concerns regarding security, safety and welfare of members and providing Snap Fitness an unfair competitive advantage from surrounding businesses. Proposed Operation The 4,857 square foot fitness studio is on the first floor of an existing commercial building within the Silverbell Office /Retail Development. The studio will provide a variety of fitness equipment for independent use by members. Staff will be at the studio on Monday through. Thursday from 9 A.M. to 8 P.M.; Friday from 11 A.M. to 6 P.M.; Saturday from 9 A.M. to 4 P.M. and Sunday from 11 A.M. to 4 P.M. To ensure a safe environment for members, video surveillance will be located throughout the facility. The studio will be accessed by using a key card. Panic lanyards will be available for members use inside the studio. These lanyards maybe taken home by members after hours and returned the following day. The lanyards contain CUP-08035 Snap Fitness microphones as well as speakers. In the event of an emergency, the security company will be able to communicate with the member via the lanyard to verify the emergency and contact emergency services. As a condition of the CUP, staff is requiring a security plan that will be accepted by the Planning Department and Marana Police Department. Per the currently adopted Town of Marana Outdoor Lighting Code, .parking lot lighting within the commercial development is shielded and can remain on throughout the night. Illumination for advertising signs shall be reduced by 50% at 11 p.m. Neighborhood Impact The commercial development has a land use designation of "C" (Commercial). To the rear of the development is Common Area "B" (Natural Open Space) of the Continental Reserve development. To the north, across Silverbell Road is a residential development with land use designation of "MD" (Medium Density Residential). To the west, across from the Picture Rocks Wash, is the McGuire Development with a land use designation of "C" (Commercial). To the east is the Silverbell Plaza commercial development with a zoning of "NC" (Neighborhood Commercial). Public Notification The application for this public hearing was properly advertised and all property owners within 300 feet of the subject property were sent letters informing them of the proposed use. One call from the public against this conditional use request was received by staff. Two letters against the conditional use permit were received prior to the Planning Commission meeting of July 30, 2008. Copies of these letters are included in this packet. I am a concerned citizen living-along the Silverbell Overlay District_ .The district was set up to maintain the security and privacy of the communities along Silverbell road. I strongly urge the Planning Commission to recommend disapproval of CUP-0$035- Snap Fitness Conditional Use Permit. First of all, with the business being located within family communities, it is not desirable to encourage it to stay open beyond the Silverbell Overlay District's established hours of operation. The hours were set to maintain security and privacy in the area.. Late hours of operation encourage traffic along this route and potentially unwanted visitors Secondly, allowing one business to stay open late sets the precedent for other • businesses in this area to do the same. Having already witnessed violations and disturbances in the area, it reaffirms my concern regarding this issue. DISCUSSION. Reauest The applicant, SBBL Architecture and Planning, on behalf of Lu's Investment Group, LLC. requests approval of a development plan for a China Buffet restaurant. Location The proposed project is located on Lot 2 of the Ruby Tuesday plat, Book 62 Page 96, at the southeast corner of Arizona Pavilions Drive and Cracker Barrel Road (adjacent to the Texas Roadhouse Restaurant). Proiect Description The site has a gross area of 1.3 acres (56,668 square feet); the proposed building floor area is 7,900 square feet. The proposed height is approximately 36 feet which includes the ornamental tower. The height of the main building is approximately 27 feet. The maximum height allowed by the specific plan is 39 feet. The building will have wood frame construction with a stucco finish, simulated stone accents, cement tiles and a flat roof with decorative parapets. This project was reviewed under the new commercial design standards and the proposed building meets those standards. Zoning and Land Use Designation The zoning for the site is F (Specific Plan -Continental Ranch). The land use designation is *C (Freeway Commercial). The Freeway Commercial designation allows for a restaurant as a permitted use. Transportation This project will have two access points. A shared entrance with the approved Ruby Tuesday's Restaurant will be off of Arizona Pavilions Drive. The second entrance will be off of Cracker Barrel Road. The site will have seventy (70) parking spaces exceeding the required forty (40) spaces per the Continental Ranch Specific Plan. DISCUSSION Request The applicant requests preliminary plat approval fora 35-lot single family detached home subdivision on approximately 78.11 acres. Location The proposed subdivision is generally located on the south side of Tangerine Road, approximately 1.8 miles east of Interstate 10. History On November 21, 2006 the Mayor and Town Council adopted Ordinance 2006.30, approving a rezoning for Ironwood Acres from Zone "C" (Large .Lot Zone). to "R-80" (Residential, 80,000 square feet minimum lot size). The proposed subdivision is subject to the conditions of the rezoning ordinance. This project was presented to the Planning Commission on July 30, 2008. The Planning Commission is forwarding this to the Town Council with a vote of 6-0 (Commissioner Winger absent) to approve the preliminary plat. Project Description The Ironwood Acres plat proposes 35 single family lots with the smallest lot size of 80,022 square feet (Lot 3) and an average lot size of 81,673 square feet. The overall disturbance of the site including all access roads, septic tanks and leach fields is limited to a maximum combined total of 30 percent. Transportation All roads within the subdivision are proposed to be private and maintained by a homeowners association. This project will have access from Tangerine Road. Per the rezoning ordinance, the developer will be responsible for the design and construction of a deceleration lane and acceleration lane on Tangerine Road at each access to this project, subject to design approval by the Town of Marana. The typical street section is a 46-foot wide right-of--way, with 28-feet of pavement. A design exception from the Subdivision Street Standards to change from the standard 24" roll curb and gutter to a flat ribbon curb 2- foot wide and 1-foot deep and the removal of the required 5-foot sidewalks on both sides of the roadway was approved by the Planning Commission on July 30, 2006. 090308 PRV-07093 Ironwood Acres PP TC Impact Fee Area The individual owners will be responsible for all applicable park and regional transportation impact fees payable at building permit issuance. Infrastructure The development is proposed to be served water by the Town of Marana. A water service agreement is required prior to approval of water plans. The applicant will dedicate to the Town approximately 2.5 acres for a well site to serve this project. Trico will be the electric provider. Each lot will have its own septic system. The applicant is requesting by separate action that the condition #17 of the rezoning Ordinance 2006.30 which required that a "dry" sewer with house connection services be installed to each individual lot for future connection to an offsite sewer be removed. If the request if approved by the Town Council, the plat mylars will be revised to reflect the condition removal. ATTACHMENTS Application, location map and plat reduction. RECOMMENDATION Staff has reviewed the request against the requirements of the Marana Land Development Code and conditions of the rezoning Ordinance No. 2006.30. This preliminary plat is in conformance with all required development regulations and design guidelines. DISCUSSION History On November 21, 2006, the Mayor and Town Council adopted Ordinance 2006.30, approving a rezoning for Ironwood Acres from Zone "C" (Large Lot Zone) to "R-80" (Residential, 80,000 square feet minimum lot size). Seventeen conditions were required of the property owner as part of the rezoning approval. One condition placed on the rezoning by the Town Council was Condition #17 which states the ". developer shall construct a sewer with house connection services installed to each individual lot, for future connection to an offsite sewer." At the Town Council meeting of November 21, 2006, the property owner was asked by the Council if he agreed to the additional conditions. It was acknowledged that the owner's representative concurred with all conditions, including #17. Request CPE Consultants, on behalf of the property owner, Stonehaven Development LLC, request the removal of condition #17 of Ordinance No. 2006.30. They believe a future connection is unworkable due to economic, topographic and distance issues. Staff has provided a letter from CPE Consultants that gives their justification in more detail. _ ATTACHMENTS Location map, a copy of rezoning Ordinance 2006.30, a letter of request from the CPE Consultants, and a copy of the Town Council meeting minutes of November 21, 2006 regarding the rezoning. RECOMMENDATION Staff does not support the request for removal of condition #17 from Ordinance No. 2006.30. We ask that this request be placed on the Mayor & Council Agenda for Sept. 3, 2008, the same date as the subdivision plat is scheduled. Condition #17 requires the construction of an on-site sewer for future connection to an off-site sewer. In this case, a future connection is unworkable because: 1. Pima County Wastewater Management advised that there is no future off-site sewer planned nor even conceived in this area. 2. The Dove Mountain trunk line exists 3/8 mile east but is located 50' higher in elevation than Ironwood Acres. This connection would, therefore, require a $400,000 energy inefficient lift station and construction of a force main sewer in Tangerine. The on-site sewer system itself would cost $600,000 for a total price tag of $1 million or $30,000/ lot just for sewer infrastructure, not counting water, pavement, utilities, culverts, etc. 3. Another alternative would be to construct anoff--site sewer SE from Ironwood Acres over thousands of acres of State Land to "catch" the Dove Mountain Trunk Line at I-10 near Continental Ranch. This connection would. require a distance of 2 miles at a cost of $800,000 or $45,000/lot, including on-site sewer. Please let us know if you have any questions or require any more information. We don't think that anyone was aware that there were no off-site sewers existing nor planned to serve Ironwood Acres by gravity at the time .this condition was added to the rezoning. The applicant proposes a change of zoning from the C- large lot zone to R-80 which is a single family residential $0,000 sq. fl. minimum lot area. The tentative development plan calls for the 35-lot subdivision with a maximum of 30 percent site disturbance. The applicant is going to be responsible to prepare a resource protection plan with the submittal application and preliminary plat. The project will have a one internal loop local system connecting Tangerine Road and an emergency access road which is located to the east. The internal road network depicts connections to future development in the southern and eastern edges of the projects. The private streets are being proposed currently and will be designed to meet the Town street standards. The closest sewer line is a connection that lines approximately 13,050 feet to the east of the subject property. Currently that line is not within the sewer basin area that serves • this property and based on information from Pima County Waste Water the nearest sewer to serve this area would be the ones involved in the Gladden projects to the west. Mr. Reuwsaat addressed Council and stated Mr. Winters is present representing the applicant and he has concurred with the additional conditions including number 17. Upon motion by Council Member Escobedo, seconded by Council Member Blake, Ordinance No. 2006.30 was unanimously approved with the 17 recommended conditions. 4. The Saguaro Ranch phase III plat is a partial re- subdivision of lots 43 through 45, block 3, and a portion of common area A of the original Saguaro Ranch final plat. The Saguaro Ranch phase III subdivision will consist of lots 43 through 45, 66 through 9b, and common areas A and B. The zoning for the Saguaro Ranch and this subdivision is RD180 which is single family 180,000 sq. ft. minimum lot area, average lot size is over 200,000 sq. ft., and maximum allowable disturbance of 20 percent. WHEREAS, Planning Resources represents the property owner of approximately 78.94 acres of land generally located on the south side of Tangerine Road, approximately 1.8 miles east of Interstate 10 in Section 4, Township 12 South, Range 12 East; and, WHEREAS, the Marana Planning Commission held a public hearing on October 4, 2006, and at said meeting voted 6-0 (Commissioner Dailey excused) to recommend that the Town Council approve said rezoning; and, WHEREAS, the Marana Town Council heard from representatives of the owner, staff and members of the public at the regular Town Council meeting held November 21, 2006, and has determined that the rezoning should be approved. Section 3. The intent of the rezoning is to allow for the development of a 35 lot residential subdivision. This rezoning is subject to the following conditions, the violation of which shall be treated in the same manner as a violation of the Town of Marana Land Development Code (but which shall not cause a reversion of this rezoning ordinance): 1. The property owner shall comply with all provisions of the Town codes and ordinances current at the time of development, including, but not limited to, requirements for public improvements. 2. No approval, permit, or authorization of the Town of Marana authorizes the applicant and/or landowner to violate any applicable federal or state laws or regulations, or relieves the applicant and/or landowner from the responsibility to ensure compliance with all applicable federal and state laws and regulations, including the Endangered Species Act and the Clean Water Act. The developer shall dedicate, or cause to have dedicated, 150 feet of new right-of--way along Tangerine Road running the entire length of the north portion of the property upon request by the Town of Marana. 6. The developer shall dedicate, or cause to have dedicated the area designated on the Tentative Development Plan as the "Future Town Well Site" upon request by the. Town of Marana. 7. A water service agreement is required with Marana Water prior to approval of water plans and final plat. 8. The developer shall be responsible for the design and construction of a deceleration lane and acceleration lane on Tangerine Road at each access to this project, subject to design approval by the Town of Marana. 9. Before a building permit is issued for any structure on the property, the developer shall have completed or shall provide evidence to the Town's satisfaction that the developer has made a diligent effort have the property annexed into a fire district or otherwise provide for fire • protection service. 10. Lots shall be limited to a maximum grading disturbance of 18,000 square feet including driveways, access roads, septic tanks and leach fields. During the platting process a restrictive covenant in a form acceptable to the Town Attorney shall be recorded against the property to protect the natural open space outside of the 18,000 square foot grading area. 11. The applicant shall consult. with the Coalition for Sonoran Desert Protections (CSDP) as a part of any reconfiguration of envelopes and/or lots that change the drainage flows and/or impact the riparian habitat areas during the platting process. 12. Fencing is prohibited outside of the allowable graded areas. 13. Roadway culverts shall be elevated to facilitate small-species wildlife crossing, as accepted by the Town of Marana. 14. Private streets shall be designed to Town of Marana standards and, to the extent permitted by Town standards and approved by the Town Engineer, shall include speed humps or other features that reduce vehicle speeds and/or reduce wildlife road-kill. 15. To transition between this development and the adjacent lower-density Arizona State Trust Land, the applicant shall increase the buffer to Arizona State Trust Land by setting back the grading limits to the extent feasible on the lots that border the Arizona State Trust land on the southern and eastern boundaries of the property. 16.
