MARANA RESOLUTION NO. 2000-63
A RESOLUTION OF THE MAYOR AND COUNCIl, OF THE TOWN OF MARANA,
ARIZONA, ACTING AS THE BOARD OF ADJUSTMENT, GRANTING A VARIANCE TO
MR. AND MRS. JOHN AND TRACEY GUTIERREZ FOR THEIR PROPOSED
OFFICE/WAREHOUSE PROJECT SUBMITTED BY PLANNING RESOURCES LOCATED
AT 6890 NORTH CAMINO MARTIN WITHIN A PORTION OF THE NORTHWEST
QUARTER OF SECTION 6, TOWNSHIP 13 SOUTH, RANGE 13 EAST.
WHEREAS, Mr. and Mrs. John Gutierrez are the owners of 4.28 acres of property
located at 6890 North Camino Martin and specifically in a portion of the northwest quarter of
Section 6, Township 13 South, Range 13 East, more particularly described in Exhibit A attached
hereto and incorporated herein, and has applied to the Town of Marana for approval of the
variance for the proposed office/warehouse project; and
WHEREAS, the Marana Land Development Code requires a minimum lot size of one (1)
acre in the Heavy Industrial (HI) zone, and Mr. and Mrs. John Gutierrez have requested a
variance to allow a minimum lot size of less that one (1) acre; and
WHEREAS, the Marana Town Council, acting as the Board of Adjustments, finds that
strict application of the applicable works an unnecessary hardship; and
WHEREAS, the Marana Town Council, acting as the Board of Adjustments, finds that
granting the requested variance is the minimum necessary action to afford relief; and
WHEREAS, the Marana Town Council, acting as the Board of Adjustments, finds that
the variance does not allow a use which is not permitted in the zoning code, so long as the
development of the property substantially conform to the tentative development plan on file with
the Marana Planning Department on this date and so long as such development of the property
begins within the next twelve months; and
WHEREAS, the Marana Town Council, acting as the Board of Adjustments, finds that
the variance will not cause injury to or adversely affect the fights of surrounding property
owners; and
WHEREAS, the Marana Town Council, acting as the Board of Adjustments, finds that
the variance is in harmony with the general intent and purpose of the zoning code and the
specific provision for which the variance is requested; and
WHEREAS, the Marana Town Council, acting as the Board of Adjustments, and
pursuant to A.R.S. §9-462.06 is empowered to grant such a variance, and believes that such a
variance is authorized by A.R.S §9-462.06 and is in the best interest of the Town of Marana,
Arizona; and

WHEREAS, the Marana Town Council, acting as the Board of Adjustments, has heard
from the representative(s) of the owner, staff, and members of the public at the regular Town
Council meeting held June 6, 2000, and has determined that the variance submitted by Planning
Resources, for the proposed office/warehouse project on a 4.28 acre parcel is in the best interest
of the residents of the Town of Marana and should be approved.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of
Marana, Arizona, acting as the Board of Adjustment, authorizing that the variance for the
proposed office/warehouse project submitted by Planning Resources, located at 6890 North
Camino Martin and more particularly described in Exhibit A, be conditionally approved, such
that the development of the affected parcel shall substantially conform to the tentative
development plan on file with the Marana Plannine Department on this date. This variance will
expire in the event that development of the affected parcel either not be~in within twelve months
or not substantially conform to the tentative development plan.
PASSED AND ADOPTED by the Mayor and Council of the Town of Marana, Arizona,
this 6th day of June, 2000.
