HomeMy WebLinkAboutResolution 2000-075 preliminary plat silverbell placeMARANA RESOLUTION NO. 2000-75 A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA APPROVING THE PRELIMINARY PLAT FOR SILVERBELL PLACE SUBMITTED BY D.R. HORTON, INC. FOR A 153-LOT SINGLE FAMILY DETACHED HOME SUBDIVISION ON 39.45 ACRES LOCATED WEST OF SILVERBELL ROAD BETWEEN CORTARO ROAD AND INA ROAD IN A PORTION OF THE W½ OF SECTION 35, TOWNSHIP 12 SOUTH, RANGE 12 EAST. WHEREAS, the Town of Marana approved and adopted the zoning on this property on November 16, 1999 (Ordinance 99.26) located within the corporate boundaries of the Town of Marana, Arizona; and WHEREAS, D.R. Horton, Inc. is the owner of the property located west of Silverbell Road between Cortaro Road and Ina Road, particularly within a portion of Section 35, Township 12 South, Range 12 East and has applied to the Town of Marana for approval of a preliminary plat for 153 single family detached home lots on 39.45 acres, including lots 1-153 and common areas "A" through "C"; and WHEREAS, the preliminary plat was presented to the Marana Planning Commission on May 31, 2000, and the Planning Commission recommended 7-0 that the Town Council approve the preliminary plat with conditions; and WHEREAS, the Marana Town Council has heard fi.om the representative(s) of the owner, staff, and members of the public at the regular Town Council meeting held July 5, 2000, and has determined that the Silverbell Place preliminary plat submitted by D.R. Horton, Inc. should be approved, with conditions. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Marana, Arizona authorizing that the preliminary plat for 153 single family detached home lots on 39.45 acres of property located within a portion of the W½ of Section 35, Township 12 South, Range 12 East approved subject to the following conditions: 1. Final approval of the water service agreement prior to the final plat being considered for approval by the Town Council. 2. Approval by the Parks and Recreation Director of the on and off-site recreation. 3. In accordance with the rezoning conditions, the 25-acre park site to the east of Silverbell must be dedicated to the Town prior to the final plat being considered for approval by the Town Council. In accordance with the rezoning conditions, the developer shall enter in to a Development Agreement with the Town addressing phasing, off-site roadway and drainage improvements, and contribute to the signalization of Silverbell and Ina Roads prior to the final plat being considered for approval by the Town Council. 5. Approval of an archeological mitigation plan by the Arizona State Museum prior to the issuance of grading permits. 6. Zoning of surrounding property, in particular the High Density Residential site to the north, shall be disclosed to all future subdivision residents. 7. Approval of minor technical revisions required by the Planning Director. PASSED AND ADOPTED by the Mayor and Council of the Town of Marana, Arizona, this 5th day of July, 2000.
