MARANA RESOLUTION NO. 2000-91
A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA,
ARIZONA, ACTING AS THE BOARD OF ADJUSTMENT, GRANTING A VARIANCE TO
GERALD AND JAY WOEHLCK TO REDUCE THE MINIMUM SETBACK FOR HORSE
CORRALS FROM 200' TO 50' FOR THE NORTHERN BOUNDARY ONLY OF THEIR
PROPERTY LOCATED AT 5050 W. ANGEL DRIVE LOCATED SOUTHEAST OF THE
CORNER OF DOVE MOUNTAIN BOULEVARD AND TANGERINE ROAD WITHIN A
PORTION OF SECTION 1, TOWNSHIP 12 SOUTH, RANGE 12 EAST. ASSESSOR'S
pARCEL ~dMBER 216-02-006B.
WHEREAS, Jay and Gerald Woehlck are the owners of approximately 4.15 Acres of
property located at 5050 W. Angel Drive, southeast of the corner of Tangerine Road and Dove
Mountain Boulevard within a portion of Section 1, Township 12 South, Range 12 East, more
particularly described in Exhibit A attached hereto and incorporated herein, and has applied to
the Town of Marana for approval of a variance for their horse corrals; and
approved the zoning of this property R-144
WHEREAS, the Marana Town Council f~.) on October 3, 2000 per Ordinance
(Single-family residential, minimum lot size 144,000 sq.
2000.15; and
WHEREAS, the Marana Land Development Code requires a minimum setback for horse
corrals of 200' in the R-144 Zone; and
WHEREAS, due to the dimensions of the Woehlck's property this setback cannot be met
on all four sides; and

WHEREAS, Gerald and Jay Woehlck have requested a variance to permit a 5
on the northern boundary only of their property; and
WHEREAS, the applicant, Jay Woehlck, owns the adjacent, affected property to the north
with her mother, Tana Miller and Staff has received a letter from Ms. Miller supporting the
proposed variance; and
WHEREAS, the Marana Town Council, acting as the Board of Adjustments, finds that
strict application of the applicable Town Development Standards poses an unnecessary hardship;
and WHEREAS, the Marana Town Council, acting as the Board of Adjustments, finds th~at
granting the requested variance is the mnumum necessary actaon to afford relief; and
the Board of Adjustments, finds that
WHEREAS, the Marana Town Council, acting as zoning code; and
the variance does not allow a use which is not permitted in the

WHEREAS, the Marana Town Council, acting as the Board of Adjustments, finds that
the variance will not cause injury to or adversely affect the rights of surrounding property
owners; and
Marana Town Council, acting as the Board of Adjustments, finds that

specific provision for which the variance is requested; and
