OF PAGES: 2 SEQUENCE: 20001750438 09/08/2000 RES 16:37 MAIL AMOUNT PAID $ 8.00 MARANA RESOLUTION NO. 2000-99 A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA, ACTING AS THE BOARD OF ADJUSTMENT, GRANTING A VARIANCE TO TRICO CLECTRIC COOPERATIVE FOR THEIR PROPOSED OFFICE/ADMINISTRATION SUBMITTED BY ERICKSON, LEADER, MARTINEZ ARCHITECTS, INC. LOCATED ON A 40-ACRE SITE NORTH OF TANGERINE ROAD APPROXIMATELY ~ OF A MILE EAST OF INTERSTATE 10 WITHIN A PORTION OF THE SOUTHWEST ¼ OF THE SOUTHWEST ¼ OF SECTION 31, TOWNSHIP 11 SOUTH, RANGE 12 EAST. WHEREAS, Trico Electric Cooperative is the owners of 40.0 acres of property located on the north side of Tangerine Road approximately ~ of a mile east of Interstate 10 and specifically in a portion of the southwest ¼ of the southwest ¼ of Section 31, Township 11 South, Range 12 East, more particularly described in Exhibit A attached hereto and incorporated herein, and has applied to the Town of Marana for approval of the variance for the proposed office/administration project; and WHEREAS, the Marana Land Development Code provides for a maximum building height of 30-feet in the "AG" (Agricultural) zone, and Trico Electric Cooperative have requested a variance to allow an increase in permitted height to 47-feet; and WHEREAS, the Marana Town Council, acting as the Board of Adjustments, finds that strict application of the applicable works an unnecessary hardship; and WHEREAS, the Marana Town Council, acting as the Board of Adjustments, finds that granting the requested variance is the minimum necessary action to afford relief; and WHEREAS, the Marana Town Council, acting as the Board of Adjustments, finds that the variance does not allow a use which is not permitted in the zoning code, so long as the development of the property substantially conform to the Conditional Use Permit on file with the Marana Planning Department on this date and so long as such development of the property begins within the next twelve months; and WHEREAS, the Marana Town Council, acting as the Board of Adjustments, finds that the variance will not cause injury to or adversely affect the rights of surrounding property owners'~ and WHEREAS, the Marana Town Council, acting as the Board of Adjustments, finds that the variance is in harmony with the general intent and purpose of the zoning code and the specific provision for which the variance is requested; and WHEREAS, the Marana Town Council, acting as the Board of Adjustments, and pursuant to A.R.S. §9-462.06 is empowered to grant such a variance, and believes that such a Marana Resolution No. 2000-99 Page 1 of 2 variance is authorized by A.R.S {}9-462.06 and is in the best interest of the Town of Marana, Arizona; and WHEREAS, the Marana Town Council, acting as the Board of Adjustments, has heard from the representative(s) of the owner, staff, and members of the public at the regular Town Council meeting held September 5, 2000, and has determined that the variance submitted by Erickson, Leader, Martinez Architects, for the proposed office/administration project on a 40.0 acre parcel is in the best interest of the residents of the Town of Marana and should be approved. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Marana, Arizona, acting as the Board of Adjustment, authorizing that the variance for the proposed office/administration project submitted by Erickson, Leader, Martinez Architects, on a 40-acre site located north of Tangerine Road approximately % of a mile east of Interstate 10 and more particularly described in Exhibit A, be conditionally approved, such that the development of the affected parcel shall substantially conform to the Conditional Use Permit on file with the Marana Plhnning Department on this date. This variance will expire in the event that development of the affected parcel either not begin within twelve months or not substantially conform to the tentative development plan.
