MARANA RESOLUTION NO. 2000-113
A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA,
AUTHORIZING THE RELEASE OF THE ASSURANCE AGREEMENT BETVv~EEN U.S. HOME
CORPORATION, FIRST AMERICAN TITLE INSURANCE COMPANY, AND THE TOWN OF
MARANA FOR LOTS 1-392, COMMON AREAS A (PRIVATE STREETS), B (GOLF COURSE),
C (DRIANAGE FACILIT][ES) AND D (LANDSCAPE AREAS).
WHEREAS, Heritage Highlands is a subdivision located north of Moore Road, west of Dove
Mountain Boulevard containing Lots 1-392, Common Areas A (Private Streets), B (Golf Course),
C (Drainage Facilities) and D (Landscape Areas), and is recorded at the Pima County Recorder's
Office in Book 48 of Maps and Plats, Page 3i; and
WHEREAS, the Town has previously entered into an Assurance Agreement with U.S. Home
Corporation, (beneficiary) under Trust No. 4699 and First American Insurance Company, (trustee),
recorded at the Pima County Recorder's Office at Docket 10277, Page 1669; and
WHEREAS, U.S. Home Corporation, has fulfilled its obligation under the Assurance
Agreement for Lots 1-392, Common Areas A (Private Streets), B (Golf Course), C (Drainage
Facilities) and D (Landscape Areas), and has requested to be released from the Assurance
Agreement; and
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Marana
as follows:
Herita e Highlands containing lots 1-392 and Common Areas A (Private Streets), B

(Golf Course), C (Drainage Facilities) and D(Landscape Areas), are hereby released
from the Assurance Agreements subject to the following conditions:
Common Areas A (Private Streets), B (Golf Course), C (Drainage
Facilities) and D (Landscape Areas), will be owned and maintained by an
Association of Individual Lot Owners.
All improvements within Heritage Highlands are on private property. The Town of
Marana will not become responsible for maintenance nor will the Town "own" any
of the improvement.
