OF PAGES: 4 SEQUENCE: 20002070078 10/25/2000 RES 09:58 MAIL AMOUNT PAID $ 8.00 MARANA RESOLUTION NO. 2000-116 A RESOLUTION Of THE MAYOR AND TOWN COUNCIL OF THE TOWN OF MARANA, ARIZONA, AUTHORIZING STAFF TO BID ON THE ACQUISITION OF STATE LAND AND ENTER INTO A LEASE WITH THE ARIZONA STATE LAND DEPARTMENT, AND DECLARING AN EMERGENCY TO EXIST. WHEREAS, the Town of Marana desires to acquire the property described on Exhibit "A" (the "ProlSerty"); and WHEREAS, the Town of Marana has entered into a Development Agreement providing for a cooperative effort toward the lease of the Property; and WHEREAS, the Town Council of the Town of Marana believes that the acquisition of the Property through the attached lease wilI directly benefit the Town of Marana and its residents through augmentation of revenues and the development of commercial and recreational facilities. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Marana, Arizona, as follows: Section 1: Town Staff is directed and authorized to bid for the Property as directed in executive session this date, in order to secure use of the Property for the To~vn of Marana, and is further authorized and directed to deposit any earnest money and/or security deposit which is necessary to complete the lease of the Property. Section 2: The Lease Agreement on file in the Clerk's office is hereby approved and upon successful bid for the Property, staff is directed to enter into this Lease Agreement pursuant to direction given in executive session this date. Section 3: All actions of the officers and agents of the Town which conform to the purposes and intent of this resolution whether heretofore or hereafter taken shall be and are hereby ratified, confirmed and approved. The proper officers and agents of the Town are hereby authorized and directed to do all such acts and things and to execute and deliver all such documents on behalf of the Town as may be necessary to carry out the terms and intent of this resolution. Section 4: The operation of this resolution is necessary for the immediate preservation of the public peace, health and safety and an emergency is hereby declared to exist, to wit: the immediate acquisition of the Property in order to comply with bid requirements of the State Land Department; and this resolution shall be in full force and effect from and after its passage, adoption and approval by the Mayor and Council. 4 Marana Resolution No. 2000-116 Page 1 of 2 Section 5: All ordinances, resolutions, or motions and parts of ordinances, resolutions, or motions of the Council in conflict with the provisions of this Resolution are hereby repealed, effective as of the effective date of this Resolution. Section 6: If any section, subsection, sentence, clause, phrase or portion of this Resolution is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions hereof.
