HomeMy WebLinkAboutResolution 2000-134 release of assurances for continental ranch sunflower phase IVMARANA RESOLUTION NO. 2000-134 A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA, AUTHORIZING THE RELEASE OF THE ASSURANCE AGREEMENT BETWEEN DEL WEBB'S HOME CONSTRUCTION, INC., FIRST AMERICAN TITLE INSURANCE COMPANY, AND TOWN OF MARANA FOR LOTS 458 THROUGH 556 AND COMMON AREAS O-O THROUGH U-U, AND ACCEPTING FOR MAINTENANCE THE PUBLIC IMPROVEMENTS IN CONTINENTAL RANCH SUNFLOWER PHASE IV. WHEREAS, Continental Ranch Sunflower Phase IV is a 20.90 acre subdivision located north of T.win Peaks Road and east of Silverbell Road containing Lots 458 through 556 and Common Areas O-O through U~U as depicted on Figure 1 and incorporated herein by this reference, and recorded at the Pima County Recorder's Office in Book 52 of Maps and Plats, Page 29; and WHEREAS, the Town has previously entered into an Assurance Agreement between Del Webb's Home Construction, Inc., (beneficiary) under Trust No. 4742 and First American Title Insurance Company, (trustee), recorded at the Pima County Recorder's Office at Docket 11032, Page 1197 assuring the completion of public improvements; and WHEREAS, Del Webb Home Construction, Inc., has completed the public improvements acceptable to Town standards in accordance with the Assurance Agreement for Continental Ranch Sunflower Phase IV. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Marana as follows: Section 1. Continental Ranch Sunflower Phase IV, lots 458 through 556 and Common Areas O-O through U-U are hereby released fi.om the Assurance Agreement between Del Webb Home Construction, Inc., under Trust No. 4742, and First American Title Insurance Company. Section 2. The Town accepts for maintenance, including maintenance of regulatory traffic control and street signs, .64 miles of paved streets for the following appurtenances, as depicted on Figure 1: Cottage Garden Place Juniper Shadows Way Morning Light Way Wandering Spring Place Wandering Spring Way Wishing Star Drive Marana, Arizona Resolution No. 2000-134 Page I of 2 Section 3. Common Areas O-O through U-U, as depicted on Figure 1, shall be owned and maintained by the Sunflower Community Association, Inc. Section 4. The Developer shall comply with all Linear Park financial contribution requirements to the full satisfaction of the Town.
