A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA,
AUTHORIZING THE RELEASE OF THE ASSURANCE AGREEMENT BETWEEN U.S. HOME
CORPORATION, FIRST AMERICAN TITLE INSURANCE COMPANY, AND THE TOWN OF
MARANA FOR LOTS 1-150, COMMON AREAS A (LANDSCAPE) AND B (DRAINAGE
FACILITY); AND ACCEPTING FOR MAINTENANCE THE PUBLIC IMPROVEMENTS IN
QUAIL CROSSING.
WHEREAS, Quail Crossing is a 38.85 acre subdivision located north of Moore Road, west
of Dove Mountain Boulevard containing Lots 1-150, Common Areas A (Landscape) & B (Drainage
Facility), a~d is recorded at the Pima County Recorder's Office in Book 49 of Maps and Plats, Page
4; and
WHEREAS, the Town has previously entered into an Assurance Agreement with U.S. Home
Corporation, (beneficiary) under Trust No. 4699 and First American Insurance Company, (trustee),
recorded at the Pima County Recorder's Office at Docket 10438, Page 400 assuring the completion
of public improvements; and
WHEREAS, U.S. Home Corporation, has completed the public improvements acceptable
to Town standards in accordance with the Assurance Agreement for Quail Crossing.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Marana
as follows:
Section 1. Quail Crossing containing lots 1-150 and Common Areas A (Landscape) &
B (Drainage Facility), are hereby released from the Assurance Agreement between U.S.
Home Corporation under Trust No. 4699, and First American Title Insurance Company.
Section 2. The Town accepts for maintenance, including maintenance of regulatory
traffic control and street signs, 1.16 miles of paved streets for the following appurtenances,
as depicted on Figure 1:

Section 3. The Town accepts for maintenance public drainageways, as depicted on
Figure 1.
Section 4. Common Areas A (Landscape) & B (Drainage Facility), as depicted on Figure
1, shall be owned and maintained by an Association of Individual Lot Owners.
PASSED AND ADOPTED by the Mayor and Council of the Town of Marana, Arizona, this
19th day of December, 2000.
