HomeMy WebLinkAboutResolution 99-100 release of assurances for public improvements on harvest moonMARANA RESOLUTION NO. 99-100 A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA, AUTHORIZING THE RELEASE OF THE ASSURANCE AGREEMENT BETWEEN PULTE HOMES CORPORATION, A MICHIGAN CORPORATION, FIDELITY NATIONAL TITLE AGENCY, INC., AN ARLZONA CORPORATION, AND THE TOWN OF MARANA FOR LOTS 1 THROUGH 101 AND COMMON AREA A, AND ACCEPTING FOR MAINTENANCE THE PUBLIC IMPROVEMENTS IN SILVER MOON. WHEREAS, Silver Moon is a subdivision located south of Silverbell Road; east of Coachline Boulevard containing Lots 1 through 101 and Common Area A, (2.305 acres), and is recorded at the Pima County Recorder's Office in Book 51 of Maps and Plats, Page 55; and WHEREAS, the Town has previously entered into an Assurance Agreement with Pulte Homes Corporation, a Michigan Corporation, (beneficiary) under Trust No. 10,912 and Fidelity National Title Agency, Inc., an Arizona Corporation (trustee), recorded at the Pima County Recorder's Office at Docket 10903, Page 1774 assuring the completion of public improvements; and WHEREAS, Pulte Homes Corporation has fulfilled its obligations under the Assurance Agreement for Lots 1 through 101 and Common Area A (private drainageways and open space) and has requested to be released from the Assurance Agreement; and WHEREAS, the release of assurances for the reasons set forth above and the affirmation of responsibility for maintenance of public improvements and streets is in the best interests of the residents of the Town of Marana. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Marana as follows: Lots 1 through 101 and Common Area A (private drainageways and open space) in Silver Moon are released from the Assurance Agreement subject to the following conditions: None Page 1 of 2 Maram, Arizona Resolution No. 99-100 The Town accepts for maintenance 0.966 miles of the following paved streets and their associated appurtenances: a. Golden Moon Way e. b. New Moon Way f. c. New Moon Place g. d. Silver Moon Way Shining Moon Way Rising Moon Way Copper Moon Way The Town accepts for maintenance a 10 foot utility easement for lots 1-101 and a public sewer and utility easement abutting lot number 41.
